Visitor visa expired?

To begin with,

1- I am currently on an expired visitor visa
2- My husband is a permanent resident.
3- My husband and I are from the same country, we meet one year ago, while he was home visiting.

I came to Canada on a visitor visa. We got married recently when my visitor visa was still valid. We then filled for spousal sponsorship.

My question is:

Will the fact that my visitor visa has expired negativelly affect our application?

Any input will be appreciated.

are you applying INLAND or OUTLAND?

If you are applying INLAND you can apply having an expired visa, however be ready for INTERVIEWS and DELAYS, plus chance of being deported.
If you already have a REMOVAL ORDER, I think you cannot apply INLAND, you will have to leave and apply OUTLAND.

Thanks boasorte.

We have already applied for the PR. We did apply INLAND when my visitor visa was still valid.
My visitor visa then expired 1 month later.

Thus am wondering being on an expired visitor visa while the PR application is in process can negatively affect the outcome?

If your status expired less than 90 days ago, you can ask to get it restored for $200. Aside from that, you are in the country illegally and could be deported, but you are allowed to apply inland with illegal status, so it shouldn't affect your application.

Thanks guys.. very helpful...

I have one more question. When I do renew my visitor visa, will I be qualified to take part time classes at a local university while waiting for my PR application to go through?

Should I switch to a study permit or stay on a visitor visa in that case?

I am currently pregnant and only want to take part time classes not full time.

Will being on the study permit will imply that I take only full time classes (i.e. International student status) or will I have the freedom to be only part time student?

A study permit is more for the university, when someone wants to come from another country to do a course offered here. You can take parttime classes if you like. You really should extend your visa asap.Even though you can apply out of status its not always a good idea. The question they are going to ask themselves is why you didnt apply to extend? And in worse case they could send you back to your country and tell you to apply through your country(worse case) so get your extension in.

if you want to change your visitor visa, you have first to restore the expired one, taking the risk of it be denied and you be asked to leave the country. And if they do restore your expired visa then you will be able to apply for a STUDENT OR WORK visa.

I guess you didnt know you could have sent in an app with your inland process. You could have sent an app for a work or study permit with you PR app and it would have put you under implied status.

It depends on how long the course is. "You can study for a maximum of 6 months with a Visitor's Visa. You do not need a Study Permit (student visa) if you are planning to take a course or program in Canada with a duration of six months or less."
