wife's open work permit applied on basis on my closed WP - valid till July 21
She is working as a contractor, contract ends July 19.
My TRV expires Sep 26th, 2014
Wife's TRV expires July 21, 2014

I am planning to apply BOWP tonite, tomorrow. Do I need to apply wife's open work permit as well? her passport is with Indian consulate for re issue because her passport expires July 22, 2014.
Can she work with her current open work permit or does it expire on May 02, 2014 because that when my contract ends?
The confusion is she already has open work permit and she doesnt have passport with her. Even she has passport how is the new open permit going to be any different than what it is now?

1) You may apply for BOWP, but it's not within 4 months from expiry of your WP, so this will almost likely lead to rejection.

2) She can continue to use her WP for other jobs until its validity.

When do you expect to get her new passport?

What do you mean company is asking you to go back to India?
Wait till June 1st and apply for BOWP.
 
I believe you will not be eligible for BOWP until May 26' 2014. You will need to apply around that date. The catch for you is to be here till that date. Then you can apply for BOWP. Once your BOWP is approved (~15-20 days), you can apply for your wife's OWP. You should be good as long as you apply for OWP for your wife before Jul 21.

I hope you will get your wife's new passport also by that time.

Your wife can work as long as her OWP expires (Jul 21).

my current closed work permit will expire on May 02, 2014. This is what is in the seperation email from the Canadian branch here. So I am within 4 months criteria

Now I'm confused....what date do you have on your WP (the CIC document)?

Maybe the company is saying: "you can only work until May 2, 2014?" Is this date consistent with your immigration document?
 
Seperation Mail from the canadian branch of your company doesnt matter. What matters is the WP expiry date on your Work Permit which I think is Sep 26 per your first post.

so with that email dont you guys think that CIC will realize that I have to leave less than a month and that if I write in explanation letter that this is what I got from my company, BOWP will still be rejected?
 
Until what date are you stamped-on (in your passport)?
You may stay in Canada until this date...doesn't matter what your company tells you.
 
Yes I know I can stay but I want to know if I have apply open work for my wife now or after she gets her passport and my BOWP.

Your company is not an immigration agency, they cannot ask you to leave the country. They may ask CIC to revoke your WP but until then your WP is valid.
 
I'd rather wait for the new passport.
As pointed out, the earliest you can apply for BOWP is May 26....

Hi

If you apply for bowp it will surely get rejected since your actual work permit expiry date is Sept end. (Don't think about the separation email for now).

But if you want to inform your employer about your BOWP before the contract end date, Still you can do it but with little risk.

1. Apply for bowp paper application by end of April. Now the current processing time is 43 calendar days. So almost by May end , they will open your application by that time you will be eligible for BOWP.

2. Inform your employer that you are going to continue stay in Canada since you moved to "Implied Status" with the new work permit application.

If you are lucky, it will surely work for you. Lets give a try.
 
^ My 2 cents:
1) I'd rather do online application on May 26; since the expected processing will result in almost the same date; plus I can check my application status online. It gives me time to prepare and gather documents too. Besides, if he applies end-April, should he include the employer under "Current Employer" even if he knows he's leaving in a couple of days? This may create more confusion especially if CIC decides to verify the info directly with the employer.

2) Why would I inform my future former employer about my plans to stay when they're even kicking me out of the country?
