Urgent help Needed: Sponsor Eligibility Question

Hi Everyone,

I'm a Canadian citizen living and working in the US at the moment. I'm planning to sponsor my wife (currently with US GreenCard) to obtain the Canadian PR but I am concerned about my sponsorship eligibility. I am planning to move back to Canada after my wife obtains the PR status.

I may have trouble providing evidences that I will move back to Canada later as I am not planning to look for a Canadian job/place at the moment. The game plan is to start planning for the move back to Canada when we get closer to obtaining her PR status. We are still in US at the moment mainly because of our new born child. We don't want to plan for big moves while she is still very young.

So the question is: Does it make sense to start the application process now? Will I run into a lot of problems with not able to provide clear evidence that I am moving back? or Should i just wait until I physically moved back to Canada?

The reason why this is urgent is due to the need to make an important family decision soon, the details are too much to include here so I'll leave that part out.

Anyone with similar experience or know someone who has been through similar situation?

Your advice or comments are much appreciated.

Someone with more experience will answer. But yes you are able to. By writing in detail what your plan would be when the time comes. And possibly adding (if it is possible for you) to come to Canada before and find a home and a job.

There is also the possibility to sponsor her inland which someone again will give you more details on. If she is a US citizen then she is visa exempt and you can both come to Canada during the sponsorship process. The inland route does not have the option to appeal though. I believe that is the only draw back to doing it that way.

Just wanted to let you know you have options. Everyone is super helpful here and will share their experiences.

By chance, when you move back, would you stay with relatives for a few weeks/months until you find a house? If so, your relative can write a letter, inviting you and your spouse to live there OR you can sign a 'roommate' agreement with that relative pending PR for your spouse. She can sign one too. You can get the roommate agreement free online.

If you plan to buy a house, you could contact real estate agents. Save a few emails back and forth, then include them as proof. (Or a copy of a receipt for earnest money, etc.)

If you would need to sell a house in the USA, you can do the same thing with a real estate agent (s) here. If you're on a lease, talk to the landlord about switching to a month-to month lease because you'll need to move back when you get the PR visa, but there aren't guarantees when it would come. Save emails/texts discussing it and (hopefully) landlord agreeing. !

Yes, we may stay with our relatives while we settle down. Would the "roommate agreement" be sufficient enough to prove that I intend to move back? We are planning to keep our home in the US so we won't have that additional supporting document.

It would show intent.

There was one user who posted that she basically included nothing except a note it was impossible to job search or house search months before her move, so she was waiting until they got their PPR to even begin. They got approved and are now in Canada!

Are you planning to lease the house? If so, you may have a property manager/management company maintain the house. A contract with them or emails showing your dealings might help too.

We are also both living in the US right now. We wrote a note explaining that our intent was to move as soon as applicant received PR, but that with the current processing times, it was not practical to conduct a job search at this time, or to try and secure accommodation. We included a letter from a family member (my adult daughter) that said she knew of my plans to relocated to Canada..how happy the family was that I would be returning..we could stay with her and she would give us all the help she could to re-establish..etc. I was approved to sponsor very quickly. However, you should be aware that when they are getting ready to issue the COPR, they have been asking sponsors not living in Canada to provide proof that they have or returned to live in Canada or their return is imminent. At that time you will need to have strong proof of your return or your application could be denied. You will need to be prepared to have your concrete evidence in place when they request it. With the wide range of approval times possible, the timing can be tricky.

No, we are likely a few months (or more!) away from COPR, but I follow a couple of threads on this forum closely (one for US Outland Applicants and one for Ottawa VO) and when information is requested regarding sponsor return to Canada, they have been providing job offers &/or job search records, real estate/rental documents (for both leaving US and finding housing in Canada), quotes from moving companies, letters from family, bank account/money transfers, and copies of any correspondence that supports the move plans. It is difficult to know when your application is getting close to approval, but there are threads on this forum for applicants from almost every month and for every VO, with spreadsheets that track group applicants. (links to the November group and Ottawa group sheets links are below my post) These are very helpful in at least giving you an idea about typical processing times, although there are always a few people in the groups who get approved very quickly and a few that take much longer....
