URGENT:CEC applicaiton being returned

after long wait, my package was returned by mail today. very disappointed but will fight it through the CIC. Letter states that
1. I don't meet requirements of Regulation (R) 10 of IRPA because
A) it was not accompanied by the original results of English test. But I did send original sealed envelop( send by CELPIP - for GENERAL test) which is being opened by CIC and returned. I see a CIC stamped on the CELPIP envelop with the date when it was being received.
2. I have been asked to provided my spouse's "birth Certificate" and mentioned that we don't accept passport as the certificate of birth including the secondary school of records. I had given an extract of my spouse's "Certificate of Birth" from my Consulate which had everything (Spouse name, parents name). Not sure what more I should do?

please suggest

thank you Maza....in the mean time I have already requested a copy of the CELPIP score. Any suggestion for my spouse's proof of birth? what should I do as she does not have any birth certificate?

anyone else with some more suggestions? please helppppppppppppp

CELPIP was mentioned by mistake.. Several others had faced the same issue. But in every case where an application was returned because of CELPIP / IELTS transcript, there was another mistake in the application. In your case it was the birth certificate.

A date of birth certificate is not same as birth certificate. If you're referring to Date of birth certificate from Indian consulate, CIC does not consider that as birth certificate. It merely confirms that the information in the passport is verified. Only a few lucky ones get away by submitting the date of birth certificate.

A birth certificate should be obtained from the municipality of the place where the person was born.

Hello Eds. you make lot of sense. So what should I do.. should I go to any near by officer (recognized by CIC as getting from my country will take a lot of time).. also it was not issued during the time y spouse was born....please advise...

one other thing.. while re-submitting my application, should I print everything again as there are lot of tick mark (checked by CIC personnel)

Hello John - For birth certificate, if your spouse don't have birth certificate then submit her high school certificate and ask her to do an affidavit with any near lawyer. Hope this will help for sure for the birth certificate.
I do not have the birth certificate, I'm from India and I have submitted my SSLC (10th class certificate) and provided an affidavit.

thanks Sri_Sai.. very helpful I wish I could have done this.. then why should I spend money to get a certificate of birth from the Consulate if they don't consider it.

filling the application again is big pain in the .... anyway can I get the affidavit from local commissioner/notary public. would that be fine.. anyone to share the latest affidavit format?

yeah, it is fine if you can get it locally. Either ur spouse can do affidavit for her or her parent can do affidavit for her.
Either ways is ok. About certificate from councelate, its been bring up in this forum lot of times that CIC don't accept that certificate. I'm not sure about ur timeline, if ur application just got back before AOR then still its fine. If its returned later stage then its bad, one of my frnd had the same case and he got his application back before AOR after that he send an SSLC certificate and affidavit which worked out for him. Wish you good luck don't give up everything will be ok.

Does the hospital / local municipality have record of her birth? If yes, you can simply place a request for issue of a new birth certificate at the municipality.

Else, try the option that Sri Sai mentioned.

Hello John - For birth certificate of your spouse please send an Affidavit from an attorney. My wife too didn't have a Birth certificate and since she is in USA she got a that notarized by Public Notary. The content looked something like this. And also, attach a copy of 10th Certificate. Hope this will help. All the best. Mine was accepted.

Declaration by Spouse Applicant Regarding Birth Certificate.

I, [First and Last Name] (DOB), currently residing at [Address] do hereby truthfully declare the following

- I was orn on XX XX XXXX

- My parents' names are [Father's Name and Mother's name]

- I do not have a birth birth ceritificate because [The reason]: I had put as " I never had one from municipal office"

- Please refer to my High School leaving certificate for confirmation of my date of birth

Dear John,

I was in similar situation as you before, my application was also returned as my wife forgot to sing on one of the page!!
I know how it hurts, but nothing much lost except some weeks

Firstly, for me also in CIC refusal letter they mentioned about my IELTS along with signature issue ,
even I had sent my original and my score was above CLB.So don't worry on English exam result,
I think they have wrong format of refusal letter which always say about english exam result :)

Secondly on birth certificate, I had same issue. Here is the set of documents I have given and they accepted
- Secondary School leaving certificate ( Which should have full name, DOB and parents name )
- Affidavit signed from notary ( I got from this guy http://www.ottawaseniors.com/links/detail/40875/valu-notary-15-ottawa-notary-public-commissioner-of-oaths-15.html ), let me know if you need a content
- I also took certificate of birth from Indian embassy, but its purely optional

Thirdly on refilling application, its absolutely not needed, just resend same including your wife birth certificate.
In my case too they marked and ticked many things on all the paper, but I sent the same one,
just go though once for your understanding and try to keep a copy, if you like add any additional docs its perfect time to add.

If in case CIC released new version of document after your initial submission, then you need to resend the changed forms, if not it not required

Just add a covering letter and explain them what all the additional documents you added to support your wife DOB and request them to accept your application.

Don't worry much every thing will be al-right with this and you vl receive your AOR soon, all the best
