Hi all,

I'm sharing with you a true story happened to me with the Candian Embassy and I will let you decide whether what they did fair or unfair.

I applied for tourist visa and my application was refused due to travel history, purpose of travel, personal and financial assets.

I reapplied again and this time, I included huge info and wrote a letter covering all refusal reasons in details.

Guess what! My application was refused for only one reason this time. The officer claimed that I did not declare my previous refusal in my application. This is not true as i already answer the questions in the visa form that my application was refused. Also, as I mentioned above, I wrote a letter to cover all refusal reasons with indicating the application no.

I emailed the Embassy, the response was short insisting that I did not declare my previous refusal.

I lost almost $1500 due to this which includes application fees, air tickets etc

This totally unfair, and really sad that they treated me like this

I am asking you, is this a fair treatment?

Hi,

Sorry to hear about your two successive refusals.

CIC takes non-disclosure of previous refusals/entry denied.... to any country (and not just to Canada) quite seriously.

We have seen several cases of people.... who misread/misunderstood the Background Information section about refusals, etc.... and did not declare a previous visa refusal, probably due to oversight.... or else they did not provide complete details.

In some cases, applicants got TRV refusals.... in other cases, it was worse - a 5 years ban from entering Canada due to misrepresentation

Don't lose hope :)

For me, I am %100 confident that I did not misunderstand the background information. I answered it correctly and I indicated the application no. for the refused application. I also did not have any visa refusal in my life except for this one

In case you plan to reapply, then you may want to order GCMS Notes first.... to understand why the visa officer believed that you did not declare a previous visa refusal

I dont want to reapply, They are plenty of countries worth to visit. But what I am sorry about is the $1500 loss.
In fact, I disputed the application fees via Visa company and they accepted the dispute.

you can refund the air tickets? no?

Hi,

First of all, you should not have purchased the flight ticket without getting the visa, and second if you did purchase the ticket prior to visa issuance, then you are entitled to a full refund, just send the refusal letter to the airline.

Good luck!

Are you sure that i can refund my tickets by submitting the refusal letter? My tickets are non refundable when i putchased them

I refunded the ticket of my mother whose tourist visa application has been refused. Her ticket was also non-refundable. I explained to the airline company that the visa has been refused, attached the letter, and I was refunded in the very same day.

Regardless of the airline, you should be fully refunded since you are not guilty that the visa has been refused and you are not cancelling your flight intentionally.

Many thanks for the info.

That's your responsibility. CIC is not to blame. You shouldn't have booked travel until you had an approved visitor visa - or you should have purchased refundable airline tickets.

It would depend on the airline's discretion and terms. I've also seen other so-called non-refundable tickets be refunded upon visa refusal. There's also a chance it can be recredited to another flight booking on the same airline.

Forget about refunding the tickets. Why I did not see your comments on the fake refusal reason? Of course I have to blame CIC because they refused me with a fake reason.
