UK Visa rejected on Grounds of Deception affects Express Entry?

The below written is the Letter I intend to give an explanation to the Visa denial and explain the circumstances leading to the differing name.

In 2008 when I was 20 years old, My mum wanted to be sure she will get my Brother and I into the UK.
She wanted to make my Brother and I get into the UK on a visit visa to get his British Birth Certificate from Homerton University Hospital (The Hospital my Brother was born in the UK in September 1994) as it was lost at the time.

I must quickly state that In August of 1994, I went to the UK with a Nigerian Passport that carried my Actual details.

My Mum then in April of 2008 enlisted the service of Visa Application Specialist/Agent whom she strongly believed won't fail in getting the visa.
The Agent went ahead to get a Birth Certificate from Kosofe Local Government Area of Lagos State and in turn, that Birth Certificate was used to get a Nigerian Passport in a First Name and age different from what I was actually born with. The age was reduced to 16 for reasons best known to the agent. While I was in school, The agent filled the UK application form on my behalf, made me sign and asked me to proceed to the Visa Application office in Oregun, Lagos state for my Biometrics to be captured.
The application for the UK Visa was subsequently denied on the grounds that I did not show sufficient proof that I will return to Nigeria. However, my Brother was granted a visa.

All my documents from my Primary School, Secondary School and University carry my actual age and name and it will be really expensive to fit these documents into the charade and "lie" the Agent created.

I had to wait till 2013 till I had enough money then to correct this lie.
I will like to state that, there was no Affidavit or change of name document from my Actual name and age to the one the agent my Mum used and from that name back to my Actual name.

All I did was approach the Nigerian Immigration service and told them that the Passport carried a different name and age from my actual took all documents carrying my actual age, including; University transcript, Secondary school Testimonial certificate and my Declaration of age.
The Nigerian Immigration Service (NIS) immediately withdrew that passport as I cannot carry 2 valid passports concurrently. The NIS issued me a fresh passport with my actual age and name.

My wife wanted to Surprise me with a Christmas trip to the UK, so she went ahead to fill, submit and pay for the application. I do acknowledge that I didn't get the chance to review the application as filed by her.
She didn't remember that I once had a passport history with my First name and age different from my actual and current passport.

On the 16th of August 2017, My UK Visa application was refused on grounds of;
1. Failing to declare that I was refused a visa to the UK in 2008
2. Failing to declare that I had a previous passport within the last 10 years which carried a different first name and age which was used to apply to the UK in 2008 but refused.


I want to know how to handle this under personal details where I am asked if I have ever had another name other than my current one.

Since you applied for a visa using a different name, I do believe you have to acknowledge that you used a different name while filling out the EE application. CIC will likely want to run background checks on both your actual name & the other name, just to make sure you're telling the truth and didn't commit crimes or anything under the other name.

While no crime was committed, CIC will not take your word on it. They will likely still want to at least run a background check on the name.

This previous fraud will be assessed by CIC in terms of both criminality and security, as this is a big alarm for border authorities when it comes to forged documents and false identity use. I would say its in your best interest to consult an experienced immigration lawyer, a proper one, not like the one you used before encouraging you to do what you did. He's gone now, and you are left to clean up the mess. Like i said, this is 1 shot you have to correct it, so its best to get proper legal advice and experienced presentation of your case. Just writing a life story wont be good to convince cic.

@dr feras Will I need a sworn affidavit? I ask this because, in the first instance, The other name was used solely for the 2008 Passport. There was no Affidavit to change from my Actual to the Name in the 2008 passport

No you dont, as the other name is not your new legal name, and like you said was only used in the fake identity. Your real name is still the same as your birth certificate and current passport, isnt it?

Yes My Name is still the same as My Birth Certificate and Current Passport, the other name However had my current First-name and Last Name with the other/middle name and age being the difference.

In view of these, will I need to state that I have used another name before now, Under personal information?
Yes. Once you are done filling the online forms in your profile, it will then generate sections to upload documents. One of them will be to upload evidence of previous name use/change. Since you do not have legal name change document, you can upload instead a scan of the old passport that had your different name.

You have to anyways take legal help as UK visa has been refused due to a misrepresentation. It is not a usual rejection like many others have. Also you should talk to an attorney on how to explain and what is really need to be included in your application. If you put what you have put here as it is, I am pretty sure it is not going to go well with CIC.

Your case seems to be pretty complicated, and you ought to take legal help to avoid further complications.

I agree here. You REALLY need to consult an immigration attorney. For a situation like this you should NOT be relying on the guesses and advice of non-legal-professionals...

Thank you all for the feedback. I don't want further complications and that is why I ran here for ideas on my next line of action. Can anyone recommend a GOOD immigration attorney versed in Canadian immigration laws?
