TRV refused (Bryanna, scylla, and elite members, please help)

Hello all,

I have applied for a TRV thrice and sadly, refused each time. The second refusal really disheartened me, however, my in-laws want me to apply again because they really want to see my son for the first time (he's 16 months old). My partner is Canadian and my son is also already a citizen and his passport is ready for the trip. They want us to visit sooner too because the great-grandmother might die soon and they want her to see my son before her health fully deteriorates. We requested for a 3 week visit.

My son and I visit my partner in China often. We were thinking I'd get the Visa because he is not in Canada physically and will only visit to see family. I am employed for two years (same employer) however it is home based. I declared myself as a housewife on my application.

We are planning to re-apply once we get the gcms notes so we can address reasons for refusal.

What are my chances of getting approved?
Can I declare my employment on my next application?
Do they review notes from previous applications when I re-apply?

Hi,

Sorry to hear you have been refused three times.

GCMS Notes are the right thing to do.... although I believe the actual reason for your refusals is that your partner is Canadian + your son is also a Canadian.

You probably didn't get a refusal for 'Family ties in Canada versus those to your home country' because your partner does not live in Canada.


1. When does your partner's contract end in China? How long has he been working there?
2. Does he have any end-of-contract benefits?
3. What documents can you submit for your employment? Do you have an employment contract?
4. Any evidence to show that you must be in the Philippines for your employment ie you cannot do the same work from anywhere else?
5. When did you last apply for a TRV?
6. Do you have a joint bank account with your partner?
7. A joint lease either in the Philippines or in China?
8. Did you provide any evidence for the deteriorating health of the great-grandmother?

Thanks for the reply Bryanna. I am perplexed on what else to do with my application.

1. When does your partner's contract end in China? How long has he been working there?
He started his contract August of 2015 and will end 2017. It will be again extended once the existing contract expires.

2. Does he have any end-of-contract benefits?
Flight reimbursements, end of contract bonus

3. What documents can you submit for your employment? Do you have an employment contract?
I can submit invoice details, certificate of employment directly from my employer

4. Any evidence to show that you must be in the Philippines for your employment ie you cannot do the same work from anywhere else?
My employer can write a letter that I oversee the Filipino freelancers and I take care of the hiring process (face to face interview)

5. When did you last apply for a TRV?
August 22, 2016

6. Do you have a joint bank account with your partner?
No joint bank account as of yet, we're thinking about creating one.

7. A joint lease either in the Philippines or in China?
We can submit a joint lease letter.

8. Did you provide any evidence for the deteriorating health of the great-grandmother?
We can submit documentations supporting this.

I don't mean to be a jerk or rude by crushing your hopes, but with a husband and a son who are Canadian I's say you have better odds winning the lottery or getting struck by lightening than getting a visitor visa. Any visa officer in their right mind will assume with the family situation you have that you plan to jump the fence when you get into Canada; which is not the purpose of a visitor visa. I'm afraid to say that permanent residency/sponsorship is probably the only way you'll make it to Canada.

You could try to bolster your odds with travel to other western countries such as the UK or the US to prove you'll "leave at the end of your stay", but, honestly, this isn't a good case.
