TRV denied.Please help

My daughter is a Registered Nurse and currently employed on a permanent status as OR Staff Nurse III in one of the biggest Cardiology Specialist hospital in the Philippines for more than two years now. She applied and was confirmed by CRNBC to write the examination on February 6, 2008.She applied for TRV last November 2007 planning to go to Canada earlier, to do some review, but her first application for TRV was denied.

She filed a new application on January 11, 2008 attaching some other documents; Letter of confirmation from CRNBC confirming her to write the exam on Feb. 6, 2008; copy of her Letter request to the Head of Office requesting for 15 days leave to go to Canada to write the exam, committing herself to go back to work after Feb 16. which was approved; Original copy of her Duly approved leave(Feb. 1-15, 2008) by her Head of Office, specifying that she will travel to Canada to write the exam; Copy of her schedule of duties after her approved leave (duly signed by the Head Nurse); Employment certification, specifying her salary, length of service and status as permanent employee; copy of her income tax return; Letter of invitation from her sister, married to a Canadian (notarized ,both signed by her sister and her husband)specifying that they will look after all her needs and give her a place to stay while she is in Canada to take the exam, they attached copies of their passport, marriage certificate, notice of assessment from Canada Revenue Agency; original bank certifications of her proof of funds, enough to cover her all expenses for her travels......

On January 17 her application for TRV was again denied with the same reasons as in her first application for TRV; that the Officer ,Temporary Resident Unit was not satisfied that she meet the requirements of Regulation 179, that she will leave Canada at the end of her temporary period if authorized to enter.

Because she was not granted a TRV, She will repeat the whole process again in applying for exam at CRNBC as she will not be able to take the exam on Feb 6.

May I then solicit the kind indulgence of members of this forum if they have any idea or tips on what other documents that must be submitted to satisfy the requirements for a TRV aside from the documents specified above.

We will be very grateful for any comments, suggestions and recommendations/tips for our reference in her future application for a TRV. Thank you and more power to this very informative forum

The only purpose your daughter could possibly have in writing this test is to become a registered nurse in BC.

So it is clear, whatever evidence she shows to the contrary, that her intent is to go to BC and work.

That's probably why she'll never get a TRV to take the test.

Thank you for your comments...So, therefore, we are made to understand that applications of Internationally trained nurses to take the Canadian Registered Nurse exam,( paying a fee of CAD 485.00) is a futile exercise and waste of time and money as the VISA Officer will not grant them TRV to take the test, because their ultimate purpose is to work as nurse in BC if they pass the exam.Then why does the CRNBC still accept applications of internationally trained nurses to take the exam? I am just confused and wondering why? I reiterate my thanks for your prompt reply..Regards to everybody

I don't think they bother themselves with the specifics of TRVs and whether the applicants will be allowed into Canada. They are only concerned with eligibility to sit for the exam.

If you think about it, it makes sense. If they told you you're not allowed to register for the exam because they didn't think you'd be allowed in the country, you might reply "but that isn't your decision to make." And you'd be right.

So they allow you to register, and let you figure out how to get into the country.

Probably not all international applicants are denied. I'm thinking that visitors from visa-exempt countries would be allowed to visit for this purpose. But those from non-exempt countries would face higher scrutiny. (I don't know this for sure)
 
Let analize all the documents forwarded to Canadian Visa Section:

It is very clear that there is one missing link in the application i face same Visa Refused Before but then i submitted one document that gave way for granting me to visit in Canada. Come on just think .

PART 9: TEMPORARY RESIDENTS
DIVISION 1: TEMPORARY RESIDENT VISA
179. An officer shall issue a temporary resident visa to a foreign national if, following an examination, it is established that the foreign national

(a) has applied in accordance with these Regulations for a temporary resident visa as a member of the visitor, worker or student class;

(b) will leave Canada by the end of the period authorized for their stay under Division 2;

(c) holds a passport or other document that they may use to enter the country that issued it or another country;

(d) meets the requirements applicable to that class;

(e) is not inadmissible; and

(f) meets the requirements of section 30.


This are the contents of regulation 179 the documents above submitted is irrelevant when you will take consideration of 179. So please analyze well. This is my last reply to this post.

JM_of_d_East nice attitude when someone is asking for help!! Thsi forum is for people who have specific needs and need staight up answers..not someone who gives a little but not all because they had to figure it out for themselves so why shouldn't the others! Moderator??

If she's married to a Canadian and has been denied for the TRV, then apply for PR. Thai-guy has mentioned before that the percentage is higher to be accepted, and sometimes quicker.

CANADA NEEDS NURSES!!!!! What's the problem here?

First of all the reason why the canadian immigration is not giving all the informations is for them to filter the deserving ones to visit and migrate to thier country thus its includes good thinking and resourcefulness on how you will convince the Visa Office to approve for youre application. It doesnt matter if you are a lawyer or something its the documents that counts when applying for TRV or for immigartion status. Thai-guy is correct nurse has a high demand in canada but there is an "if" clause on it. And that is "if you passed the NCLEX licensure exam".

Do you think that she has not shown that she has family ties in her own country that she will leave Canada at the end of the period authorized for their stay under Division 2;

DIVISION 2 has differents Conditions.

CONDITIONS ON TEMPORARY RESIDENTS


General conditions

183. (1) Subject to section 185, the following conditions are imposed on all temporary residents:


(a) to leave Canada by the end of the period authorized for their stay;



(b) to not work, unless authorized by this Part or Part 11; and



(c) to not study, unless authorized by this Part or Part 12.

HI THERE.. well im in the same situation perhaps.. id like to take the college of registered nurses in manitoba examination.. i am about to appply for a tourist visa. id be staying in canada for pn;y 3 days and will go back to the philippines immediately after the 3rd day... is is possoble that theyll grant me a visitor visa with no much difficulty?
 
The only way to be granted with TRV visa is a Letter of Assurance from work or from school the you are with mentioning that they will take the responsibiliy that you will return right away once youre TRV expires.

My mom has been applied twice but it was refused.
She send a lot of documentation but her visa was denied because they are no convince that she is going to return at the end of her stay for the following reasons: "Family ties in Canada and her country".
My mom is widow, I have2 sisters but they are merried, my mom only take care her mom but they did not send anything that she takes care of her because we did not understand very well what they want.

What do you think we can do?
