Hi everyone,

I’m in the process of trying to sponsor my spouse from the uk to Canada. He has a criminal record from when he was 18 of drinking and driving and we have just sent the criminal rehabilitation application in then going to send in our spouse application a few months after. However, I have realised that on the ETA form the last time he came to Canada with me on a visit I said he didn’t have a criminal record (I filled it out for him as we were in a panic before our flight and I thought he didn’t have it in his record anymore). Now I’m panicking a lot because we have mentioned him being in Canada before in the application and I’m worried they will find out he came with his criminal record. Has anyone had the same experience and if so what was the outcome? We did this through a lawyer who knew he was already in Canada so I feel like he would have mentioned this would be an issue if it was. Any help/info will be greatly appreciated.

when you submit the spousal sponsorship....its good to be honest with IRCC....provide the correct information and honestly answer the questions especially in IMM5669......your sponsorship application is an opportunity to correct any previous misrepresentation.....your spousal sponsorship will be approved based on the proof of your supporting documents and the genuineness of your marriage.......good luck

We have been completely honest in the spousal sponsorship and in our criminal rehabilitation. In the spousal sponsorship we have mentioned we have been to Canada but in the criminal rehabilitation (which we need to go through so the spousal sponsership can) we forgot to mention how he came to Canada with his record. When I filled out the eta for him I panicked since we were going to miss the flight and thought his time had been served and he didn’t have it anymore (criminal laws are different in the uk). The answer I’m trying to get is will this effect the criminal rehabilitation? It already got sent in before we could send a letter explaining this.

not sure....if worried why not update IRCC with the correct information.
