Hi,

Congrats on your AOR and MR and your marriage. The fastest way to get her here is on a Temporary Resident Visa. You can then apply for an Open WP once she gets here.

Thanks

Hi Guys,
I have a query..

I have received my AOR (10 jan) and MR (14 Jan)
I got married at the end of Dec and informed AINP and CIC about it on 21st Jan...
I seek your advice:
1. What is the best way to bring my wife here from India to canada before getting PR : a. Temp. resident visa or b. Work permit. What you guys recommed and how should i go about it? (I am working - skill level A- on a post graduation work permit valid until feb 2015)

Thanks
Hi calainp.....First many congrats for your marriage....Now as far as your question is concerned i am answering this from my personnel experience. Visitor visa for your spouse from india is next to impossible if you are not a permanent resident. The chances are 5% out of 100 and that too depends how financially sound you are !!!!!! open work permit is worth giving a try bt that is again extremely thin chances. You need to convince CIC that you have plenty of financial property in india that will motivate you to go back if your PR is rejected. and plenty means PLENTYYYYYY according to CIC. My wife has been rejected twice even though i had more than $40,000 in my account and plenty of property in india. Therefore i would really suggest you dont take any chances because its just a matter of 6-8 months now and if you get a rejection thats gonna bring a lot of trouble for you in the future. The choice is yours.

Hi Kavy,

I tend to disagree with you on this. If u are already in Canada and working you should have no problem in bringing your spouse to Canada on a TRV. In your application you just state that she is coming to meet you and live with you as a dependent. I am saying this from experience, I am also from India, my spouse also came here on a TRV after we got married not once but multiple times and also got a OWP after coming here. This is true for all other colleagues who have bought their spouses here on a TRV and got a OWP. I also want to add that all of them ar PR applicants too, including me.

Thanks

Sorry for giving my opinion, even though I'm single and have no exp on this.

However, in my opinion, I would agree with Kavy, because calainp is still in a process of getting PR. If it were me, I wouldn't take a risk to bring my "further wife" here while my application is still in process, better wait until I receive my PR.

Anyway, congratulation on your marriage calainp, wish you and your wife long lived happiness :)

Again, it's just my opinion :) peace ! please don't shoot me :D

Hi Calainp,

First of all Hearty Congratulations to you and your wife and a very Happy Married Life.

As Kavy and tam_ngo said, looks like it's better NOT to add your wife to the PR application right now....just to let your PR application get processed smoothly. As per Kia99, it's also their personal experience, however it may be different from case to case. Finally, if I were you, I would ask my wife to stay back in home country until I get my PR, and then process her application...as you see, looks like June applicants are getting PPRs. So, in our case if everything goes fine, it may take about 8-9 months to get PPRs.

One more suggestions for you, try to consult one Canadian immigration attorney, they might give you exact answer analysing your case. If you want, I will provide you with their contact info as I have one.

But finally, the decision is in your hands. All the best my friend.

@ Tam_ngo:
Nothing wrong in expressing your thoughts buddy...so, no Sorry. Some times even if we don't have experience in a particular situation, we may give some good suggestions to group members...So, guys, please don't shoot our friend tam_ngo... ;) ;) ;)

Thanks,
Sarayu.

Hey Tam_ngo,

There is nothing wrong in giving your inputs, its appreciated :). But Calainp did a good job in informing CIC of his marriage, that way it wont delay the application process. Knock on wood, I have not experienced any hinderances with spousal visa or family visa because of the PR being in process. In fact mine is a pre 2008 FSW application from New Delhi, India that got converted to PNP last year. Ultimately its up to Calainp to decide what road to take. Calainp, since your have your AOR already did not get a letter for OWP also? I would also suggest calling up CIC or if you go to the airport and ask to speak to an officer there CBSA officer, they will clarify your doubts, again this is first hand experience and they have always given the right information.

Thanks,
Kia99

Hello Kia,
Well if u got one then you are one of those bunch of lucky ones. But all this varies from case to case. But you just cant go for a blind shot when you have got a target in hand. TRV is never a gauranteed visa. A visa office has to see many factors before issuing one. Infact it would be much wiser to add her on his application as an accompanying dependent now, this might cause a bit of delay but she will get PR status right along with him. Rest is upto every individual to think and decide his best. But one wrong step can cost you deeply.

Hi Kavy,

Thats true, I have been here back and forth since 2004. Again its case based, its unfortunate that your wife is stuck in India, I hope she joins you soon. It does not hurt to ask the officials at the border or the airport in Canada, they are the most helpful, better than calling CIC helpline at least.

Thanks

Hi Manju,

Yes, I think you told me this before. But I am sorry, I don't understand what you are saying exactly. I am also outside Canada applicant and got my MR in 3 days after I received my AOR. Please clarify me on this.

It takes a couple days for us to logon to ECAS web page after receiving AOR. So, nothing wrong you are doing.

Thanks,

Hi,

You can only apply for Open Work Permit for your spouse if you are working in a NOC A, B or O job on your PGWP for 6 months already and you have to prove the job is that NOC level, also your WP has to be closed i.e. tied to a specific employer. Until then your wife can only apply for a TRV. Also before and if you decide to apply for her TRV get your employer to give you a letter on the company's letterhead stating that you have been employed with them and you draw X amt of salary and this is to support your wife's application for TRV to come to Canada so you can live together. In addition to that you will have to furbish your T4's and any tax you pay in India for last 6 months, 6 months of salary proving you can support her, your rental agreement and bank statements and dont forget the marriage certificate. Again my suggestion to you would be try talking to a CBSA official or call the cic help line to see if they have changed the rules, do go to the border or the airport and talk to the CBSA officer. Also do check this link, am sure you will find some more information on the matter.
