Hi

I am a 14 year Canadian Citizen and a sponsor. I am trying to sponsor my wife to come to Canada but now its asking me about criminality on my application

18 have you been charged with an offence under an act of parliament punishable by a maximum term of imprisonment of at least 10 years

MY CRIME: 2 counts of Trafficking in controlled substance
5. (1) No person shall traffic in a substance included in Schedule I, II, III or IV or in any substance represented or held out by that person to be such a substance.
MY MAXIMUM STATED PUNISHMENT(under an act of parliament) : Schedule I or II, is guilty of an indictable offence and liable to imprisonment for life;

WHAT THE COURTS GAVE ME: 18 months conditional sentence order AKA 6 months house arrest 6 months curfew and 6 months probation.

in short i had been charged with a punishment of imprisonment for life BUT i got a conditional sentence order.

other than this i meet all the requirement and i have all the evidence there is in this world from travel tickets to love letter stating how true the love is between us. ALSO I met her 1 year BEFORE THE I got charged ( i was charged in 2010 )



I just want to know if im eligible to Sponsor her or will my application get suspended or denied

Wow! for a 14 year old you have quite a record. Where and how did you get married? to the best of my knowledge you have to be at least 16 or 17 to get legally married in Canada with consent of parent.

Many people can write a Romeo Juliet style love letter that'll bring tears to anyone eyes but in the real world you have to go above and beyond that. Unfortunately age is a big problem in your situation, immigration will be very curious about that, anyone would be for that matter. 14 is just too young and over that you have a decorated criminal past, the situation dosen't look very favorable. Having said that I'd start by getting a job, do some social work, community service, cause you'll have to convince the immigration officer you are changed and a person of good character and have left the criminal life behind you, you also have to prove you are mature and able to handle a married relationship and this is not a marriage of convenience. Some people may disagree with me but every case is different, you are young, have a criminal past, married and wanting to sponsor your wife. The last thing immigration wants in both of you hustling drugs to make a living. Be honest with all your dealing with immigration cause if you dont then that will be another black mark on your file, good luck

I believe the OP has been a citizen for 14yrsthee isn't 14 years old!!!! ::)

I don't know the answer for this I'm afraid, hopefully someone on the board has knowledge for you!!!

LOL...you all failed your IELTS reading section!!! Look carefully again at the first sentence "I am a 14 year Canadian Citizen and a sponsor". He's been a CANADIAN CITIZEN for 14 years....I had to read it twice before it clicked. I don't have any wisdom to add, but thought I should stop people going down the wrong path which appears to be littered with red herrings.

In that case it would mean he's been a Canadian citizen since 14 years and at present, in the process of sponsoring his spouse

But in all honestly I think this person is a troll, only one post and no feedback

I don't think he is necessarily a troll. First post and no feedback yet because not everybody is online 24/7 like us :p Besides, he still didn't get any proper replies.

Now I hate to say I don't know the answer here but I think PMM would. I hope he replies to this thread.

When you look at how can sponsor at http://www.cic.gc.ca/english/immigrate/sponsor/spouse-apply-who.asp you will see this:

You may not be eligible to be a sponsor if you:

-failed to provide financial support you agreed to when you signed a sponsorship agreement to sponsor another relative in the past defaulted on a court-ordered support order, such as alimony or child support
-receive government financial assistance for reasons other than a disability
-were convicted of an offence of a sexual nature, a violent criminal offence, an offence against a relative that results in bodily harm or an attempt or threat to commit any such offences—depending on circumstances such as the nature of the offence, how long ago it occurred and whether a pardon was issued (See Sponsorship Bar for Violent Crime below)
-were previously sponsored as a spouse, common-law or conjugal partner and became a permanent resident of Canada less than 5 years ago (See Five-year Sponsorship Bar for persons who were sponsored to come to Canada as a spouse or partner below)
-defaulted on an immigration loan—late or missed payments
-are in prison or
-have declared bankruptcy and have not been released from it yet.
So it mentions violent crimes only so maybe it is not a problem then.

First id like to say thank you all for considering answering my questions and secondly I just want to know if im Eligible so I dont waste anyones life/time.

I am a Canadian citizen and Im turning 27 this September. Sorry for the confusion and I hope this takes care of my age.

this is my punishment:

ok so now i understand my offence means life in prison so i have to tick YES for questions 18 in the application, but the amount i was charged with was .70 grams or less and so got a conditional sentence and not anytime in prison, i was just held for 4 hours in the cell and fingerprinted before my bail.


I have called CIC, Department of Justice, Canada Gazette(emailed), public Safety Canada, and O Canada to figure out and get an idea if my crime falls in the category of: (an indictable offence involving the use of violence and punishable by a maximum term of imprisonment of at least 10 years, or an attempt to commit such an offence, against any person)
CIC didn't know the answer and told me to just file the application and see what happens! I pleaded to talk to an immigration officer and also no luck (is there a way to talk to one by any chance?)
I asked an immigration lawyer he says your crime doesn't involve use of violence.
I asked another lawyer and he says you need to wait 10 years for a pardon.
I also called Minister’s Office Citizenship and Immigration Canada and they said i have to wait 5 years (even tho a pardon takes 10 years now) so I wasn't sure if she even knew anything. I also emailed the Minister. and I don't think they will reply.

I believe only an immigration officer knows the answer.

On the internet it states drugs CAUSE psychological damage and other violent crimes but that's the effect drugs create. So did I cause an Indictable offence involving the use of violence or ATTEMPT to commit such an offence against any person??

Maybe my English is a bit off and I don't understand this or maybe my life is now ruined for because of this criminal offence.


Please help me I know someone here must have the answer from past experiences.

Are you inadmissible because of past criminal activity?

In general, temporary residents and applicants applying for permanent residence are considered to be criminally inadmissible if the person:

was convicted of an offence in Canada;
was convicted of an offence outside of Canada that is considered a crime in Canada; and/or
committed an act outside of Canada that is considered a crime under the laws of the country where it occurred and would be punishable under Canadian law
