My wife is in USA for about a year by Dec. 30, 2010 on her graduate studies. We already sent pp upon New Delhi request on September 22,2010. They know that my wife mailing address USA and we mention on separate letter pp return back home my parents address.We sent pp with return UPS airway courier envelop to return pp to my parents back home address.

My wife don't even have pp to travel back home, pp was sent upon New Delhi request Sept.22, 2010. My wife can not travel without pp to New Delhi for interview.

Question to our all thread members.
what can we do, please looking forward for suggestion from all our thread members?

I don't want to threaten u or anything like it..
But by mailing passport u have violated the rules & regulation and it is illegal to send Indian PP by post.
It is clearly mention at back of Indian PP.

By sending PP u have made clear that your spouse is in India.

You have to get back to immigration Department asap and should convince them to your situation.

Just hope they listen u and get convince and don't take any reverse action.

And also keep in mind don't tell them that you have send it by post. But I think you have directly courier it from US to ND?
You can send PP by some person in hand by giving letter of authority.

It is better to consult to some lawyer.

Yes you can call them, But as you don't have Immigration file no. I don'y know if they will entertain you.. :(
You should make case specific inquiry.

Don't worry they will not reply to it but they will keep in record to change the address.

I also mailed them once but they didn't replied but they send the confirmation of the visa by replying to the same inquiry I had send them.

So don't worry if they don't reply.

oh ok, Il try using my client id number to ask them..if v the calling option, why isnt ppl calling? why oly email?

The only thing I can think of is might be a bit lengthy process is to cancel the application for sonsorship for now, have them return the passport send it back to the us somehow , have your wife return back to India and begin another process I was reading someone else that had to do that . Your wife At this time is at a risk for getting detained at this time in the us without a passport with the strict rules they have now. I wonder if applying from buffalo would have been a better option.

abcone: Just a heads up, on the trackitt website I read a comment about someone not being able to attend the interview because the applicant was overseas and the passport was in the possession of the visa Office. The case eventually got rejected because the candidate obviously could not attend the interview! All I can say at this point is that you have very limited options. Consult a lawyer immediately without wasting more time! Tread cautiously, Good Luck!

My saga still continues with CIC :) It will take a long time for me to receive the PR card as my photos got rejected!! This process will take about 3-4 months to complete!

sanyrog: No! You can't walk in to the consulate! Email is your best bet!

Canada immigration appeal system called for rejected visitors

Canada, 14th December: The government of Canada is likely to consider introduction of an immigration appeals system following an introduction of a bill in the House of Commons.

The bill has been introduced by MP Olivia Chow, a new Canadian Democrat. It will enable appeals to be made for refused Canada visa applications. Such a system of appeals is already in use for Australia visa and UK visa applications.

As of now, Canada immigration system does not have any such provision for rejected or refused Canada visa applications. So, all applicants whose Canada visa applications have been rejected by the immigration department have no option but to make a fresh visa application.

According to official figures, nearly 20 percent of the total Canada visitor visa applications received every year by Canada immigration department are refused and the main reasons for such refusal are misrepresentation of facts and incidence of fraud.


However, several legitimate applicants wanting to join their relatives for important functions in Canada including marriages, baby showers or others also get rejected by Canada immigration officials and do not have any recourse once their application receives refusal.

And the fact that the total application cost for Canada visitor visa of $75 per applicant is non-refundable adds to the woes of the applicants.


So, the new bill introduced by Olivia Chow will urge the Immigration and Refugee Board of Canada for hearing the appeals.


Every year, Canada immigration department receives around 1 million visitor visa applications.


Pointing to the proposal for an appeal system for rejected Canada visa applicants, Chow said that the aim is to bring increased transparency and fairness in the Canada immigration system.

Australia requires all rejected visitor visa applicants to pay $1,400 for making an appeal and the amount is reimbursed to the applicant in case the decision gets reversed. In the UK, there is no fee for making an appeal for the rejected UK visitor visa applicants.


It is being hoped by the bill will increase the awareness of the public towards the plight of the rejected Canada visitor visa applicants whose family members or relatives live abroad.
 
@sanyog : You can call them. but as u don't have Immigration file no., I don't think they will entertain u. But u can gv a try. There is no harm in calling. As u r going to ask about any update regarding ur case. U jst need to change ur address.

But Case specific inquiry will b better :)

Hey,I jus got a reply ND that they have created a file number starting with F00---.however no e-cas update and no information with this file number and they said your application is pending for intial review.
Guys all file numbers start with F.kindly reply.
