So I have a question about bankruptcy and/or debt settlement and how it will effect my application to become a PR Family Class into Canada.

Basically, before I left to come to Canada, I was hit by a semi-truck on the highway. Not seriously hurt, but I have medical bills I can't afford to repay, plus attorney fees, on top of debts I was grandly awarded by the court in my divorce (somehow...), and if I'm REALLY lucky, I'll get to pay property damages, attorney fees, and medical damages to the trucking company as well. Very nice considering I was the person hit, huh?

Entering bankruptcy or debt settlement is my only real option at this point. The medical bills alone are too high - this is the US healthcare system we're talking about. I'm leaning toward debt settlement because I don't trust the courts after my past two experiences.

My boyfriend and I live in Alberta. We will qualify for common-law sponsorship in May 2013, but we have been a couple since December 2010. We do plan to get married in the future, but at the moment we aren't engaged. I hold a Visitor's Record valid through November and should have a study permit arriving in the mail within the next week. My boyfriend is employed and has used his paystub to apply for my visitor record and study permit.

My question is: How will me filing bankruptcy or entering debt settlement effect my PR application? Can I file while the bankruptcy/settlement is open in courts? Will the unpaid debt against me cause my application to be rejected? Would I need to wait until the bankruptcy is over? Or would it be best to try to get my PR application asap and hope to beat the rush of creditors knocking at my door? Or just let them knock and not file bankruptcy until Immigration is complete?

At the risk of me being unable to remain in Canada, my boyfriend and I are willing to discard our dreams of having a wedding at the lake in BC where he is from and get married immediately. Being together is more important than that. If need be, I'm willing to empty out my retirement account to try to stave off the creditors until my PR application can be completed.

It won't matter if you (the American applicant) applies for bankruptsy.

It's only the sponsor who can't have an undischarged bankruptsy on their record.
