Sorry. here it is.

I am a PR card holder and my husband would like to immigrate via Express Entry.

While setting up his EE profile. when asked about whether I would be accompanying him to Canada we selected yes as I am leaving Canada to be with him during the application process, and will accompany him to Canada. This gives him 15 extra points as my brother is also a PR.

However, the application lists me as a dependent and it's my understanding that we will be asked to pay application fees for both of us, which makes no sense since I am a Permanent Resident.

I have 2 questions:
1) Would you suggest I select yes or no for accompanying spouse?
2) If no, Can my husband say he has a brother who is a PR even though he is technically his brother in law?

We just want to improve his chances of getting ITA soon.

I am sorry. I am confused now, since I am getting 2 different answers.

According to Canada.ca, “accompanying spouse or common-law partner”, in respect of a foreign national, means the foreign national’s spouse or common-law partner who is accompanying him or her to Canada and who is not a Canadian Citizen or a permanent resident. Doesn't this mean I am non-accompanying?

2) Are you saying although I am not accompanying, my husband can claim sibling points through my brother?

See you notes in the last 2-5 pages.

The eligibility takes place in 2 stages, first an analyst will review and make recommendation. Then an officer will review the recommendations and make a final determination.

Only after the officer has made a final determination, is the eligibility passed.


Can eligibility be met and part of it is under Review Required??

as its written in the GCMS notes at the end of the part of "Recommend R10 Complete Review Type" : Documents set for Review-----client information ??

can you please help me understand that part of GCMS Notes @legalfalcon

Yes, as long as all the details request by IRCC are mentioned in the work reference letter, you will be fine.

If something is missing, you can add supplemental documents, like your appointment letter, pay slips, etc. and explain in LoE.

Hi @legalfalcon

My brother has ECA: bachelors (4 years)+completion of college level certificate(one semester)- now my question is is it possible for him to claim two or more certificates? I saw a few people got PPR with the same combination and after claiming two or more certificates with it, but still is it risky? & even if he applies with it what might be his chance to get PPR? Any precaution he can take if he applies with it? your advice and detailed feedback will help tremendously. thanks

@legalfalcon:- Hi again Sir, Today i noticed that on the page where the analyst makes the comment on the right corner it is "s.16(1)(c) " only on 2 pages , where the analyst has written his comments over Review Required on eligibility but there is nothing specific on where the review is required and every thing written is MET by the analyst.Today i noticed this "s.16(1)(c)"...... Does it mean anything to worry??? Thank you Sir

I read your writing very carefully about security check. I think according to your writing, My security check was second step, agent said has already finished security data entry upload. WHICH means waiting for IRCC VO do final review? I think so, can you confirm me?
By the way, in this stage, usually how long will take? last Friday collect data part finnished and updated , can you tell me what is sequence in this part of security. thanks a lot

My application for permanent residency has been refused, The reason office mentioned was “the Canadian education you obtained from xxxxxx college is a private career college and this institution is not recognized by the provincial authorities responsible for registering, accrediting, supervising and regulating such institutions to issue the credential as defined in Immigration Regulation 73(1).
Based on the documentation submitted with your application for permanent residence, I am not satisfied the you possess an eligible Canadian educational credential pursuant to Ministerial instruction 30(4)(a) and therefore not eligible gain the claimed points.

Now I got a letter from the college stating that xxxxxx college has changed its college name to xxxxx Business College. The DLI number still remains same. Any student checking for our college details on IRCC website under Designated Learning Institutes, please note you will not see xxxxx college any more, and will find same DLI number with Business College name.

I called CIC this morning to check with them about my options, agent advised me that I can resubmit the application without claiming the Canadian education as they told me that the time period I studied (January 2015 to June 2016) this college was still not recognized during that time and the work permit which I am currently on should not be issued in the first place as it is not recognized institute, I can certainly re apply by increasing my score to overcome that 15 points drop.

I have again emailed my college to check with them of what agent advised me, the reply I got from the college is "Yes dli was there in 2015 and 2016 and every student/agent could see it on CIC website that time too. All you can say that it was dli that time. And it was. CIC cannot deny it."

What are my options now can I request a re-consideration? I got my GCMS notes as well, In the notes everything was good even the case analyst marked as eligibility recommended pass but the case officer refused it.

How much accurate is the CIC agent information over the phone?

Please help.

In my UK PCC I got a criminal record of not paying fare and traveling in train and the disposal has some amount of fine(which i have not paid as I have traveled back to India the very next day permanently). This happened 5years ago. Will this effect my CanadaPR approval.

A review required does not mean that there is an issue with your case.

You have provided addition information. However, you cannot submit self attested reference letters. You can however, submit letters from colleagues, former employees, supervisors on a plain paper which has your job duties.

If you have not done so, you can do it now.

All that the analyst has done is to ask the officer for a review of your documents before marking the eligibility has passed.

If you want IRCC to re-consider, you can send a CSE with the documents you have of the recognition of your college and request reconsideration.

Before you send your request, make sure that your educational institution was indeed recognised and you get all the documents to support your case.

If your security has concluded, then the VO will conduct a final review, before your application is approved. This can take 1-3 weeks.
