Hey everyone, I have a question.

In my EE profile, I had mentioned an aunt/uncle who holds Canadian PR.

During the post-ITA application stage, I want to remove aunt/uncle from my application as it would be a lot of work for me to prove the relationship.

Under FSW, even without claiming adaptability points for aunt/uncle, I still have 71 points out of 100 which is above the 67/100 threshold.

Is it okay for me to remove them from the application or would it be a problem?

That's fine. Remove them and add a LOE regarding the fact that your eligibility remains unaffected and explain the trouble of managing to obtain the documents from them.

My husband needs to return to india for some urgent work and we havent got our PR card yet.
1. I have read that he can apply for PRTD to come back and enter canada. Is that correct?
2. We are making our first landing in canada on 16th may. And he will come back to India on 10th june. Should he apply once he comes back to india on 10th june?
3. Understand that he needs to fill set of documents (list available on CIC website) and submit to VFS. Will he be required to do something on his CIC profile OR he needs to just submit physical documents. He is the dependent for PR and i am the primary applicant.
4. Any other pretinent guidance you can share regarding PRTD.

Thanks..

@legalfalcon could you please advise?

Please advise the checks done by LVO. My file moved to LVO in mid Feb & has been in IP2 ever since. I ask because I joined an organization in Bahrain when on a visit visa & my offer letter is dated during my visit. My work permit stamp on my passport & pcc match & this is 45 days after my offer letter. Pcc also states that there is no criminal records till date. (worked from 2008 h 2010 & pcc issued in 2017 December) submitted pcc along with my application upfront. Should I submit a letter of explanation now or just wait for a decision? Aor December 30th 2017.
The file is usually sent to LVO to determine eligibility and security. If you have changed your job and moved to a new country, you have to Inform IRCC of the same if your application is in progress, irrespective of what stage it may be.

Dear Legalfalcon
If we email CBSA on their general email requsting status update on the screening, do you think this will be useful for the application?
I doubt it, but you can definitely try and see.

YES, and employer gave work reference letter till my work permit expiration date.

Sorry for confusion.

Work permit period--January 2013 to January 2015.
Actual worked--January 2013 to November 2014.
Work Reference letter from employer--January 2013 to January 2015.

Applied for Overseas WP- 2016--mentioned my work experience January 2013 to November 2014 with above mention timeline Work reference letter. Had no issue.

Now, 2018, Applied OINP HCP category-- mentioned my Work Exp-- JAN 2013 to JAN 2015 with same work reference reference letter.

So, I m concern about cross verification with my previous application, what if they check and found out that I showed November 2014 in previous application and now I m telling JAN 2015? Does this be an issue??

Though it was from NOC C category experience and doesn't really help me to get anything. will OINP verify all mention experiences or it just a skilled work experience??

What should I do in this situation? should I tell my employer or should I talk to OINP?

Thanks
OINP will most likely not cross check, but IRCC will. When you apply to IRCC, make sure you address this in your LoE.

Thanks. I didn't but on May 4 I recieved Medical request as the upfront expired in December last year. I did the medical, doctor uploaded the results on eMedical on 10 May, and were passed in MyCIC account on 11 May. My application is in London.
1. Does a medical redo request, for sure, indicate that SS has been conculuded, and PPR is around the corner?
2. If point 1 is yes, how long does it usually take from passing medicals to recieving PPR?

Thanks

Hello @legalfalcon.

I have changed my NOC post ITA. Can you please provide me with a reason to mention the same in LOE. I have written, "After observing my reference letter, I feel this NOC is more in line with my job duties". Please let me know if should I modify this explanation. You can even suggest me a sentence.

I do not have a good vocabulary.

Thanks a ton for helping us out. :)
You do not have to provide a reason. Any canes made to the profile post ITA, if it does not impact your CRS, or does not give you an undue advantage in getting ITA, does not need an explanation.

However, if you do want to give one, what you have stated, is perfectly fine.

Hello Legal,

Please tell me in your opinion if I’m being selected for security screening or it’s only security.

Here is the whole scenario.

I overstayed my tourist visa in the USA in 1999 for two years. During that period I had 6 months probation which shows on my FBI record.

Last years I applied for a tourist visa to Canada, and I got it. However I did not go as I started the process of getting a nomination to apply for permanent residency.

I was honest about the past criminal act questions on the visa application, and I know that this does not make me inadmissible to Canada based on criminal grounds.

My OAR is December 8 2017, and the file was transferred to the Canadian embassy in my country in January 20, 2018

Last week I had an interview in the Canadian embassy in my country. The agent went through all original documents I had submitted with my online application. Nonetheless he seemed interested in the period I spent in the USA and the criminal act. He asked me the same questions I had already answered on the statutory section of the permanent residency application. I was honest in my answers, and may be he was trying to see if my answers would match what I had listed on the application. Then he was like well give me few minutes I will talk to an immigration officer about the FBI record to see what his opinion is.

After about 15 minutes he came back and handled me all my documents, photo and passport, then he told me that he would keep my country’s police record (original), and in regards to FBI records he said it will be handled by OTTAWA to do a "background", then he said this could take a month, or a years or even a day. Once they get a response they will contact me. He also advised me not to contact the embassy as they won’t have an answers since this will be handled by Ottawa.

Based on your experience, is this going to be just a security that every applicant has to go through with CSIS, or is it going to be Security screening , and is there a way I could check that?.

Thank you Legal for your valuable time and analyses.

Best Regards,
In your case it will be security screening and it will be handled by CBSA.
