Dear @legalfalcon:

I need your advise on the personal history section. I have three post secondary degrees: a Bachelor of Science, a Bachelor of Arts, and a Master of Arts (Presently doing M.Phil. but as yet incomplete). Now, the duration of Bachelor of Science was from 2000 to 2004, and while studying for this degree as a regular student, I also did Bachelors of Arts as a private candidate (2001-2003), and then studied Master of Arts (2003-2005) as a regular student. So, the time periods of the three degree overlap with each other. Is that alright? What do you think?

Start date End date Activity Name of company, employer school, facility 1999-03-12 2000-06-02 Studying ABC School
2000-06-03 2000-09-24 unemployed
2000-09-25 2004-02-27 Studying DEF University
2001-09-19 2003-08-31 Studying XYZ University
(Private student)
2003-11-10 2005-09-06 Studying XYZ University
2005-09-07 2007-02-11 Unemployed
2007-02-12 current Working XYZ University
2007-02-12 current Member of University Teachers
Organization
2017-03-16 current Studying XYZ University

Please advise if the overlapping dates, especially while studying for different degrees is alright? Thank you.
There is no concern about the overlapping dates, you can go ahead and mention that in any way you want. Through the personal history IRCC wants to figure out what you were doing in the last 10 years, no what exactly you were doing. So you can either do the following:

2000-09-25 2001-09-19 Studying DEF University
2001-09-19 2003-08-31 Studying DEF / XYZ University

Or go by what you have.

But .. if I Change my primary NOC Code (from 2171 to 2173).. do you think it will be an issue or misinterpretation case between pre ITA and post ITA profile?
You can change your NOC post ITA, no problem with it. Just make sure that you meet the CRS and MEC

I attached refusal letters from US Embassy with my LOE. Do you think I should still submit Schedule A upfront? Thanks a lot.

IRCC states the following for the work experience requirement:

The applicant must have accumulated at least one year of continuous full-time (or the equivalent in part-time) paid work experience in the occupation identified in their application for permanent residence as their primary occupation. In calculating this period of work experience, the occupation must be listed in skill type 0 (Managerial occupations), skill level A (Professional occupations) or skill level B (Technical occupations and skilled trades) of the National Occupational Classification (NOC) 2011 [R75(2)(a)].

The applicant’s skilled work experience must also

  • have occurred within the ten years preceding the date of their application for permanent residence; and
  • not be in an occupation that has been designated as a restricted occupation.
Note: At the time of publication, no occupations were designated as restricted.

In addition, during that period of employment, the applicant must have

  • performed the actions described in the lead statement for the occupation as set out in the occupational description of the NOC [R75(2)(b)]; and
  • performed a substantial number of the main duties, including all of the essential duties, of the occupation as set out in the occupational description of the NOC [R75(2)(c)].
Note: The applicant does not need to demonstrate that they meet the “employment requirements” listed in the NOC occupational description.

If you read the last line, it clearly states that that the employment requirements are not required to be met, such as education qualifications. What matters is the job duties.
Thank you so much. It eases my burden! So in this case, which date should I fill in? The graduation date on my degree or the date I started my 1st job (which is 2 months earlier than the graduation date)?

Guys I am in a dilemma and need advise. The money in my current and savings account are far above the minimum requirement for a family of 5, and have been maintained stably above the six months timeline. However, I took an investment loan from my bank last year, which results in about 20% monthly deduction from my expendable salary. From CIC guideline, I am supposed to declare this liability through a bank letter. My question is how will this declaration impact my application?

Dear @legalfalcon:
I only have a quick question. In the EE profile, "Work History" section, they ask about when you "first became qualified to practice in this occupation"

In my case, I work as an electrical inspectior under NOC 2264 (Link: https://goo.gl/BCD3uN) which states:
  • Completion of secondary school is required.
  • A college diploma in construction, civil engineering or architectural technology plus several years of related work experience
    or
Several years of experience as a qualified tradesperson in a construction trade, such as plumbing, carpentry or electrical trade are required.
I graduated highschool in 2010 and got my engineering degree in 2014, which date should I put in this field?

Please note that I only submitted my College degree for WES (ECA) evaluation so I only have my college experience certified..

Another thing: My experience certificate from my company lists me as an electrical engineer but it's not one of the listed titles in the NOC, is that alright?

Dear legalfalcon:

Thank you so much. Your advises have helped me throughout, making everything seem so clear and easy in the post ITA documentation phase.

I have one more confusion if you could please help me find the light.I am working in my department as a lecturer for the last 10 years. However, since March this year I enrolled myself into a higher research degree also at the same department where I am working as lecturer. Would this affect my claim of continuous full time work experience with 40/Hrs a week, a truthful claim endorsed by my reference letter also. Except that, only since March I have been enrolled in the degree program simultaneous with my departmental duties. I do attend about 12 hours a week of research seminar/classes, but after fulfilling my work duties. I could simply skip mentioning this enrollment in the degree program as in any case it has no affect on my already received ITA, nor may I complete it if I receive the PR Visa. But skipping it would be misrepresentation. Please help me find a solution to this dilemma.

Also, the day my work experience started, I also became member of the University's teachers association ex-officio. Should I mention that in the Organizations membership section and personal history? Thank you.

If your loan is from the same bank where your PoF is, only then you need to disclose the loan, or else just leave it. Even when you do disclose, it will not impact your PoF in anyway.

If your work experience i outside Canada, you can claim it even if it was while you were studying.

As regards the association, you should mention it.
