My representative submitted my profile and now I don't want to move forward with them. I want guidance regarding this. Is it better to ask the representative to withdraw the profile and after that, I by myself create a new profile, or should I link that profile to my gckey account.

Kindly anyone guides me with this one.
You can link the profile to a new GC Key. If your profile has been submitted, just get control of it, this way you stay in the pool and also maintain your priority in case of a cut-off. Also, send an email to the rep and let him know.

To submit your passport to a VO in another country you will need an instructions letter from IRCC. Send a web form, and also call IRCC. Unless you have an instruction letter to submit your passport to a VO in different country from where you reside, it most likely will be returned if you did attempt to submit.
Thank you so much sir! If I may ask, will there be a file transfer involved? How long will this whole process be?

@legalfalcon : Request your expert advise, I did submit PR EE application through Alberta Tech pathway. AOR was 16th Feb and today application got rejected as we couldn't attach travel document of dependent(Son) correctly.

Shouldn't they be returning and asking for more documentation rather than direct cancellation? Can you suggest a way to get this application considered on the same EE profile?

Regards

@legalfalcon recently, Ontario has been inviting healthcare professionals in the draw. I have got NOI yesterday and I'm a dentist and few-outland and don't have Canadian licenses. Some information I have collected from the people has told me that you don't need a license but one of my friends contacted an immigration lawyer and he has told him that his application will be rejected because for Onip you need to have a license to practice in Canada. Can you please guide me with this?

Hi Legal Falcon,

I landed in Regina on 01 Mar 23 with my family. When I checked for an appointment with Public Health Authority for medical surveillance, they informed me that it will take more than 2-3 months to get the appointment for doing the surveillance. I did a soft landing and have to return back within a month.

1. If I leave Canada without doing medical surveillance, Is this will affect my PR card processing and issuance
2. I will be returning back after 10 months. Can I proceed during that time for surveillance

I enquired and they informed me that it will not affect any of the PR card proceedings. Please I need your guidance in this regard.

Regulation 10 of the IRPA imposes an absolute responsibility on the applicant to submit a complete application. If the application is not complete, it will be rejected.

Only after the application crosses R10, will IRCC request additional documents or provide an opportunity if anything is required or missing.

There are no time frames published. Can take anywhere form a few weeks to a few months. Depends on the VO you are dealing with.

OINP uses the same NOC classification as IRCC. The NOC classification states that if you are a health care professional then your degree and license should be evaluated by a designated professional body.

If you have an assessment from a designated body, you do not need a license in Canada. If a license in Canada would have been required, then it would vitiate the entire goal of immigration.

However, be advised that if you are applying under a stream of OINP which is employer-driven, or work ex in Ontario etc. you will need a Canadian license.

If you were asked to get into surveillance then you have an obligation to meet that requirement. IF you have registered with the health agency, then you will be contacted as and when the resources are available. If you fail to meet the appointment, then a notice of non-compliance will be issued.

IRCC states:

If you received a notice of non-compliance with medical surveillance
If you received an email notifying you of non-compliance, this means that you haven’t complied with the medical surveillance requirement associated with your immigration or visa application.

Medical surveillance is a condition of your status in Canada. You must complete your medical surveillance requirement as soon as possible. If you don’t, it may have a negative impact on any current or new immigration applications to Canada. For example, your Canadian citizenship application could be delayed until the provincial or territorial public health authority confirms with IRCC that you’ve complied with the conditions of your medical surveillance.

If you’re having trouble completing your medical surveillance requirement, or believe you’ve completed it, email the Public Health Liaison Unit at IRCC.MHBSurveillance-SurveillanceDGMS.IRCC@cic.gc.ca. Include your full name and unique client identifier (UCI) number in your email.

https://www.canada.ca/en/immigration-refugees-citizenship/services/application/medical-police/medical-exams/medical-surveillance.html#non-compliance

You can contact the above-mentioned email.

Also, remember that is nothing as a soft or hard landing. As soon as your land and are admitted, you become a PR. Whether you stay in Canada after acquiring a PR status for one second or one year is your choice. The law had nothing that defines or distinguishes soft landing or hard landing.

Once you get a PR status, you have an obligation to meet its requirements, including residency obligations and medical surveillance.

I canceled my representative and now I have control over my profile. I want to change my email address but recently I got NOI from Onip and they have sent me the email of my NOI in the old email along with the message in my profile.
Can I change my email address right now and then apply for the onip application with the new one? Will it create any issues and can I make one key account to apply for Onip with a new email address?

Hi @legalfalcon,

My scenario is I work in a semi-government research institute doing AI/ML for cancer with the goal of publications. My job title is bioinformatics specialist, but day to day I essentially do the same thing as data scientists: visualizing data, creating ML models, data cleaning, etc for biological data. I put 41201 - Post-secondary teaching and research assistants as my NOC on my EE profile, but I feel like I can write the reference letter in such a way that it fits the 21211 - Data scientists for OINP tech draw. So, I guess there should be no issue, right?

All that IRCC wants is that your job duties should match the NOC you select. That is it.

@legalfalcon ..... How are you sir?
Its so good to see that you are still providing your invaluable service to people like me .... Respect!

My brother-in-law & sister are in BC on work permit for last 2 years and are in process of becoming a PR hopefully this year.

Once they become PR, they want to sponsor my parents for Supervisa, as they meet the income requirements (LICO).

My queries are:

1) Suppose they become PR within this year, is there any waiting time before they can apply for Supervisa? As in do they have to be PR for few days & then only they can apply for Supervisa?

2) Will their income for 2022 be considered as it is for the earning which were made during Work Permit?
I mean do they need to file tax after PR in order to show their income eligibility or the tax filed during work permit is also accepted?

3) In future, if they want to sponsor the parents for PR, then do they have to show 3 years of income eligibility from the time they become PR or can they also include their NOA for the earnings under work permit duration?

Hope to receive your advice on the above.

Once again thank you sir!

Dear sir, I hope all is well.

I have a few questions and hopefully you could kindly answer those at your convenience.

I applied under EEPNP program, the cut off score is 494 when I was invited, I was thinking about going to a full time school program this year, so probably leaving my job. My AOR is Nov 17, 2022 and the visa office is in Montreal, the current status is MEP / BIO passed, Eligibility recommended passed, BCG not started (criminal passed, info share in progress since Dec 1, 2022 and security check not started). My question is, if I got a higher CELPIP score now, then my CRS will be higher than 494, can I leave my job then? I know I must lose my nomination, but can IRCC continue proceeding my application if I update my CELPIP score to them with a CRS higher than the cut off score? Or it's easier for me to withdraw my application and then resubmit?

Thank you for your help in advance.
