My friend has provided me with his details. So, it will be fine and It will not be misleading/misrepresenting by making this online request on Indian internet servers. I was assuming it as the request will be forwarded to the nearest visa office/consulate i.e. New Delhi resulting in false representation. Thank you sir.
Misrepresentation what is described in section 40 of the Immigration and Refugee Protection Act only applies in immigration context and not when requesting GCMS notes which are processed and released pursuant to Access to Information Act or the Privacy act.

I have given you the answer and asking the same questions over and over in different ways will not change the answer.

Right to access to records

  • 4 (1) Subject to this Part, but notwithstanding any other Act of Parliament, every person who is
  • has a right to and shall, on request, be given access to any record under the control of a government institution.

The above section does not say where the PR or the citizen resides and just because you are outside Canada does not take away your status as a PR or citizen.

Hello @legalfalcon , I need to know that I got nomination from BC. After we got nomination we are now blessed with baby, we are now family of three. Is it necessary to send Post Nomination request. How much time it will take to get Post Nomination Letter? As I am w8ing for ITA now. But the nomination I got for 2 members, but now my family is extended ? I don't want to lose foremost ITA. What to do ? Thanks

Hi Legalfalcon, I have contacted MP regarding my issue and MP office reached ircc and received a response that they will provide an update in 10 days and after 10 days mp office again reached ircc and they replied no update on my spouse yet.

Meanwhile I have received a reply to my email from ircc saying " your file is being looked into by our management team and someone will be in touch with you when it is resolved".

So Does this mean they are going to reopen my file? Can I expect any positive news soon?

I have recently gotten my PR Passport request from IRCC on 11/23 and I'm having a lot of confusion regarding the submission to the NY VAC. Looks like VFS is handling the passport requests but I didn't realize I couldn't just send a Fedex package containing my documents to them. Instead I had to wait for them to slowly go back and forth on emails, 48-72 hours each time in order to get shipping labels and fees paid.

I'm currently 14 days from the original PPR email date and I'm probably still two emails away from getting my shipping label. I'd like to know what I should do if this whole process ends up too slow and I end up possibly missing the 30 day window. My worry is that my document won't arrive at the final destination office in time if it has to hop from office to office. From your experience, have you interacted with VFS a lot and could you give me some pointers? Should I email CPC-Ottawa preemptively if the timeline looks later? How do they count the 30 day window?

IF you have received a nomination, you have to inform the nominating province and provide them with an updated PoF.

If you have received a response, just wait for IRCC to open the file and resolve the issue.

IF you have received a nomination, you have to inform the nominating province and provide them with an updated PoF.
I think for BC PNP one do not need any POF. Moreover in BC PNP one can not apply without job offer and with Job offer they don't require POF. please correct me if I am wrong?

My Brother is in Canada on Study permit. Following is his details:

1) Year 2020 : College A / One Year Course / Passed with Dean's Honour.

2) Year 2021 : College B / One Year Course / Passed with Dean's Honour.


In September of 2021 we applied for PGWP and since in form IMM5710 only ONE entry in field of Education is allowed, we entered the details of College B (one year course) and following the same logic WE SUBMITTED ONLY DOCUMENTS FOR COLLEGE B and entirely left College A details and documents. (stupid of me).

Sir now we have received PGWP with One Year Validity as oppose to 3 Years of Validity (which were eligible for). I understand its totally my mistake.


Sir what can we do now?

Also worth mentioning:

1) In IMM5710, in Date of Entry to Canada, we have entered the date on which we came to canada to join University A.

2) We had submitted Complete Passport, which clearly shows Study Visa received for his travel to Join University A.

PGWP is issued based on what you claimed in the form. You will have to file a new application and include an LoE explaining the issue and requesting a new revised PGWP.

IRCC requested an ADR, IMM 5669 from myself and my accompanying spouse to be provided respectively. The Q6 of IMM 5669
asks if the applicant and other family members (listed in the application) have had any past visa refusals. While filling and submitting IMM 5669, we individually listed visa refusals related to primary applicant in his form and visa refusals related to spouse in her form. We also have a child declared in the application, who is a Canadian Citizen, we both did not mention his visa refusal which occurred post AOR in each IMM 5669 forms. The reason for this mix up was because primary applicant and spouse, both were individually asked to submit IMM 5669 and son is a Canadian Citizen who is dissociated from the application as per GCMS notes.


However we rectified the mistake, just to be extra cautious about the application and provided updated IMM 5669 forms a week later, where primary applicant listed visa refusals for himself, spouse and child and spouse listed visa refusals for herself, spouse and child in the individual forms. Do you think it was wise to update the forms and rectify the mistake with an upfront apology letter. Its just that after waiting for so long, do not want to jeopardise the application.

Now as I know, I have to fly to Canada to accept my PR and apply for a PR card. But the visa on my passport is valid for only one time entry. So once I enter the Canada border to apply for my PR card, then I will have to come back the second time, but I wouldn't have any document to come back and collect my PR card. So what should I do in this situation? Apply for a PRTD? Can I get a PR card posted from my relatives at my Canadian residence to the USA? Or do I need to go there and collect it only own?

If in doubt it is always better to disclose. Also under the law, you have an obligation to answer all questions truthfully.

16(1) of IRPA:
A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.
Since your child is a Canadian citizen, he is exempt from admissibility analysis and that is why no forms or questions are asked about a Canadian PR or citizen. However, if you did inform IRCC, no harm is done and it is better to be safe than sorry.

As long as you voluntarily disclose that is what matters.

The visa that is given to you is a one-time visa because as soon as your land and are admitted into Canda you will become PR and you do not need any visas to reenter.

The first PR card is automatically issued when you are admitted. At the port of entry when you are processed, the officer will ask you for an address where the PR card will be shipped to you. If you do not have one at that time, you can inform IRCC about the address using a web form.

PR card takes 3-6 weeks.

If you leave Canada before the PR card is issued you will have to apply for a PRTD to return to Canada see https://www.canada.ca/en/immigration-refugees-citizenship/services/new-immigrants/pr-travel-document.html
