Study Permit and open work permit for my spouse

sorry for the delay, I recently arrived in canada but i had to stay in a hotel and i recently got a place, but its small so im still looking somewhere else.
So that has made me very busy.

For my proof of funds i used:
-my spouse sister bank statement
- bank statements from 2 of my friends
- my spouse and i 2 bank accounts
- i added our car title(because we sold the car before we came here)
- my spouse boss bank statement

Is there anything else you want to know?

I applied for my study permit and work permit last ? Thursday . I checked My CIC account and there was a new set of questions to be answered for a request for EVN . I proceeded with the questionnaire, however, since i do not have 6 months of full time study within the past 12 months in Canada the questionnaire gave me an option to exit. Ignoring the options i continued with questionnaire however, the questions did not pertain to me as they asked of the institution where i have completed 6 months or more of full time study.

Reading up on cic.gc.ca website it mandates that a student applying for a work permit to fill out the questionnaire withing the next 14 days.


what do i do??

Your scenario is some what confusing. But let me explain what i know so it should help. Technically, on a student visa, you cannot work in Canada for the first six months at least. Once you have completed that time frame, you are allowed to work 20 hours a week. But you have to apply and obtain work permit for that. So currently you cannot apply for a work permit since you are applying for study permit and would only be able to do so once you have completed six months of study.

Apart from this, i have heard (though yet to read officially) that govt of Canada has allowed students to work from day 1. This is a new policy which will be applicable by jan 2014. So my guess is, any one applying right now would automatically be transferred to it as soon as the policy is in place. So you got to apply for study visa for now only, and if you want to work along, only move to canada around late jan (or when the policy is in place). You should verify this otherwise, but i have heard/read this from many students going to canada over the last few months. A lot of that has been discussed in this very forum.

The work permit therisaw was referring to, was her spousal "open work permit" which every student or worker's (in highly skilled category) spouse qualify for.

I received a student permit and open work permit for myself and a open work permit for my spouse.

Its shocking, i did not apply for the work permit because i read that i can only apply for it after 6 months. However, they gave me the approval form for both the work permit and study permit.

When i went to the immigration officer at the port of entry he looked shock too, he asked me if i was doing a coop program. I told him him no, only community service and practicum. He then gave me the study and work permit.

My school was shocked also when i told them that I received teh work permit too. the normal procedure is after 6 months of school.

So i can start working as soon as i want to.

Hey Therisaw,

That's great news. Whatever the reason, it is in your benefit. What i suspect is that it has something to do with the approval for Jan 2014 that i mentioned before i.e. students being allowed to work from day one. I also heard that the people who applied in sep would also automatically be converted into that stream by Jan. May be they thought the interval is too small for you to start processing it again. :)

hi guys! first off all: Therisaw congratulations on your student and work permit! great news! but man 9 weeks??? :eek: must be really frustrating! I am so happy that i finally found a post whats it about a combined application! i feel relieved to find some info here :)

Me and my boyfriend are in the excact same situation as you guys. at the moment we are in status of freaking out! we are dutch and applied online. we applied for a student for my boyfriend for a Phd and an open work permit for myself in july 23rd 2013. we received a confirmation via email but up till now no news what so ever. we are now waiting 50 days for our permit!!! the semester has started for my boyfriend and we are also already paying for a house in canada.

does any of you know why it is taking so long, is it because that we filed for a commen law partnership, student permit and work permit that it takes a bit longer?

and what about the strike, how is that of influence? news items are contradictory and I simply cannot figure out what is happening.

also we have no idea where our online visa's are processed. first we thought vienna. but after emailing they said its beeing filed in canada. after finally reaching canada they answerd that it is deffintly vienna. we called and emaild that we need urgent processing, we are missing first semester this way and i cannot work at the moment because we can leave any minute. is their anything else that we can do to speed up the process? anyone else had the same experience when applying online?

as you all can Imagen we are going nuts because we simply have no idea how long we still have to wait for our visas. It sounds strange but it is somehow good to know now that it can take up to 9 weeks at the moment, at least we now kinda know that we have to wait another week or two. maybe....

Hi dirkenmarjolein,

First of all, 9 months time period is specific for Therisaw considering the embassy that caters her home country. Your would be dutch or a similar one so it depends upon their own processing times. Applying online doesn't automatically changes your visa office. Your case is still processed by the respective visa office for your country or the place you physically applied for either being a national or a permanent resident. However, for online applications it is possible that embassy offloads the processing to another office at times. But this is just a rare exception - not the norm and is transparent to an application.

None of which is currently not possible. The current situation is that many embassies have been on strike since april. That has significantly affected over all visa processing and created massive back logs. It is also true that many embassies didn't have those strikes so they were not affected by back logs, unless there is a portion of application processing say security clearance which is done centrally and actually IS AFFECTED by strike.

Lastly, temp work permit programs has undergone major over all because of several high profile exploitation cases in Canada. You can read about the Royal bank of canada issue of misusing twp program. So accelerated LMOs have been cancelled. The work permit program is under more scrutiny, and hence is taking more time in general. Also study permits (mostly for masters) have the highest priority in terms of visas, then comes visit visas and finally work permits.

To give you another example i live in a country where average processing times of work visas is any where between 4 to 9 MONTHS. But generally speaking if one has a high profile skilled job and all docs are clear, people get visas pretty quickly i.e. in 2 to 3 months.

Two of my friends / former colleagues with pretty much similar circumstances to me applied around Nov 2012 to Jan 2013 and both got visas with in two months. This is pretty fast for our visa office. Where as i applied around april and it took about 4.5 months to get to medical call stage (Medical is a requirement in our country and it generally means that your visa processing is otherwise accepted, though there are rare rejections after medicals too).

Another significant factor is the time of year in which one applies for work permit. April to september is high time for study visas so embassies generally are overloaded with applications. This means work permit applications submitted during this time frame takes far longer than those submitted around winters.

These are all the factors i came to know of while waiting painfully long for visa application materialize.

Knowing that might help and makes the wait easier.

we waited 56 days.

@fkl you where right, it is different for everyone. thanks for all the info, it really helped to put the case in another perspective

Hi Priya83,

I have had a similar experience with you. I am not much of an authority on this but i will give you my modest opinion.

I think that form is automatically generated by your application once you request for work permit with your online application. It will continue to be there on MyCic for you to apply for it once your situation fits its requirements. Just like you, I also started filling the application for EVN even tho i saw the option to exit but after a few more questions, i realized it wasn't applicable to my situation since i dont have 6months of full-time study at my school yet.

You don't have to worry. Did you notice the instructions at the beginning of the form? It says "after 14days, the system will delete the incomplete one you didn't submit. If you want to submit it again, you will have to start afresh and fill out your info all over again" (not that you will not be able to submit the form at all after your 14days expire ;D)

So just let the 14days expire and the system will automatically wipe off the incomplete EVN form you filled and restore it back to the part where it asks you to complete a new form. So long as the acceptance letter from your school has already clearly stated that work practicum is an essential part of your studies, you are Ok. You will get a work permit anyways whether you fill the EVN form now or not.

I think that is why Therisaw got a work permit even tho she didn't apply for one. Both co-op programs and courses that require work practicum need a work permit in other to participate.

So just relax and pray for your invite to medicals just as am doing now ;)

I would be very kind of you to suggest me what visa will be best in my situation to get my family along with me.
My wife can show her fathers property and her gold valuation for herself which sum up to - 8,15,000.00CAD
and also few cash in bank account .

I had one option in my mind is to enrolle her in diploma course but she is not good at her English language .

You will be going on student visa for masters, so your spouse qualifies for an open work permit and your child should have a temp resident visa.

Just show your assets like the ones you already mentioned though i only know of cash in hand / account or property. Never thought or heard of gold being used in this regard.

Any way approval of your primary application for visa is the most crucial part, which requires you to have enough funds to cover your cost of education and living for at least a year. Since you intend to take family along, it should cover that too.
