Hi All,

I first came into Canada in 2013 but only stayed for short periods of time, now I moved permenantly in july 2016, and found a job in November 25$/Hr and just finished the propational period and got 28.5$/Hr now, i am afraid i am not eligible for super visa application for my parents since i am below the minimum income required, my family consists of myself+wife+3 kids+ both parents=7 family members =65,000$ and I am making 59,000$.

i am from somalia,only one of my parents work in uae,mother is a housewife, parents own a properity in UAE, which I hope can be considered as a good home tie to UAE.

currently I dont have a house rented under my name,but i will do if that will make my case stronger,or if the embassy will require proof of accommodation for my parents.

my questions:

1- is there excemption if i dont reach the minimum income requirements,or if i show that my parents are well established financially and have a good saving accounts, my employer said they will write a good to whom it may concern letter stating that i am a good employee and after completing a year they will again raise my salary and it will get above the threshold....would that even work?....is there any otherway to overcome this issue of not reaching the minimum thresold,my wife still back at uae...so i am only here in canada.

2- 2 of my kids dont have PR but i successeed in getting them a TRV for each, which will expire in july 2017, so technically my family size is 5, since my 2 kids are not PR yet, or shall i wait till their TRV expire and then apply Super visa for my parents for family of 5..!!

3- this might be extreme,but i was weighing the option of asking my wife to cancel her PR along with one kid who also have a PR and also 2 TRV for the other 2 kids, this might hit 2 birds in one stone, since my wife already passes the 2 out of 5 years residency in Canada,and we are not pretty sure when she will move to Canada permenantly, so i was thinking to cancel wife and kids PR/TRV do super visa for parents ( now 3 family size, me and parents ), then after some time apply again to sponsor wife and kids or she can registered for the skilled worker immigration program since her job is on demand here in Canada......will this scenario work..!!.....if yet, after how much time can I reapply for my wife and kids to sponsor them and would having a canceled PR negatively affect their case?

4- do my parents need to make medical check up prior getting a reply from the embassy or they should wait a request from them as a second step after checking elgibility and stuff.

5- can i apply online for my parents..!

6- when exactly my parents need to do eye and finger scans before the application or after applying online ?!...is there a code number generated online they need to present.

7- would it help if i send a humaniterian letter along with the invitation letter that i am the only child of my parents and giving them access to visit me for 2 years would help me settle better in canada, would that help or make it worse by giving them more doubts that my parents have sronger ties in canada than in uae and they might not go back to uae ( altough my wife and kids are still there in uae).

appreciate all ur advises but i seriously need it..........i would appreicate as well if there is a good and honest lawyer i can speak to who can help me get my case approved.

Cancel the PR does not matter as the family size is not based on visa status but based on relationship only. Why don't you apply for the normal visa instead of super visa?

1. No - no exceptions. You must meet the income requirements or it's an automatic refusal.
2. You must include your wife and children in the # of family members count regardless whether they have PR or not.
3. No - won't work. See above.
4. They should do the medical in advance of applying. But no point since you don't qualify to sponsor them.
5. Normally you can apply online. However you don't qualify to sponsor them.
6. Before. But again, you don't qualify.

Lawyer can't help you fix this - don't waste your money. Renting a house will not make your case stronger. The only way to fix this is for you to find a job that earns enough income to meet LICO that covers yourself, your wife, all of your children and your parents. Until you do this, super visa isn't an option.

By GOD's grace, the manager accepted to increase my salary to 31.5$/Hr, i dont know how to calculate the annual income exactly but the manager after i showed his cic minimum income table for 2017 and made his calculations said that should cover me up,i am new to the company and just passes my propapational period this is my first job in Canada since 2013, my questions again if you dont mind:

my family members size is 7, so according to cic supervisa minimum income requirement is 65,101 $....i think the manager just divided that amount on 2080 hours( 40hours x 52 weeks), is this calculations correct..!!

1- my next payment should be after 2 weeks ,my next pay slip should show my new salary 31.5/hr , how soon can I apply for super visa for my parents, will employment certificate showing salary and good words that the company are keen to hire me for long term ,would this help and make my parents case stronger.

2- i dont have family accommodation right now,i am subleting a room in an apartment, is it a must to show proof of accomodation /housing enough for 7 family members, by all means since i passed my probabational period i was thinking to rent 2 bedroom appartment starting april, should i hold applying super visa till i find house to rent.

3- what other citiera the embassy in abu dhabi look for , one of my parents only work , do they reject applicants based on nationality, like somalia, my parents own a free hold appartment there, would that be considered a home tie to UAE,

4- where my parents can get health insurance for 2 years in canada?! do they have to purchase before applying for super visa and include it in the application or that would be at later stage ,maybe after initial approval..!!. if visa is rejected can the money be refunded to the health insurance company.

5- should my parents do the medical exam before starting the visa application or should i wait answer from the embassy first.

6- my wife and kids still in uae, my wife works there and she passed the residancy obligation period, would she be in danger when i apply for the supervisa to my parents as i have to give details about family memebers.

7- is the process easy and straightforward and i can gather the required documents and apply online or should i go to a laywer and make him prepate the case for me.

8- ,GOD forbids, if the case is rejected, how soon can i reapply again.

9- what is the difference between normal visit visa and super visa aside from the longer period, i know a lot of people got rejected when applying for visit visa becuz of no home times to country of residence and strong tie to family members in canada,i.e they wont leave canada, but is this case different when applying for supervisa ?
