I'm the main applicant and my spouse has gap on his work experience. There's no way I can provide his employment cert nor paystubs. I'm not claiming points from his work experience. My main concern is his previous jo b without work permit. How do I declare it or should I declare it?
Do you think CIC will refuse my application?

If you did not claim points for it than it shouldn't matter if you remove them. I removed one of the two work experiences I listed for my spouse because I was unable to provide evidence, I did for the other one though. I haven't gotten PPR yet but my application already passed the eligibility stage so I am sure that it didn't matter that I removed that experience!

Good luck with your application :)

Thank you for the response. +1 for you.
That was his first job when he came here. I can only provide job contract and NOA, are these docs sufficient?. Will there be problem if I can't provide certificate of employment and does CIC has access to CRA accounts?
Thank you.

That should suffice or you could always opt to leave it out of your application altogether. CIC should not require for you as the PA to confirm your spouse work experience because again, as you said, you did not claimed points for it. :)

Don't claim points for it and don't state it as if cross checking is done you have no proof to produce except your verbal confirmation.

Working without a work permit in Canada is pretty illegal -
1. No legal status
2. No employment insurances
3. No employment accident insurances
4. No payment of taxes
and the list goes on and on.

If you do not have supporting legal document to state your status in Canada while working here your file can easily be blacklisted. So stay away from it and do not declare it only if you are confident that CIC cannot find out about this under the table employment activity. Goodluck.

My spouse 's gap in employment has T4, insurance etc but unfortunately no Lmo (refused) which I think is still not allowed. Main concern is his first job when he came,he worked there for 3 months where I can only provide contract and Noa. I'm not sure if it will suffice.
I'm not also sure if can leave the spouse work experience in Canada portion blank since I'm not claiming points for it. Will there be any discrepancy or it is really required to fill it out?

If you're not claiming those 10 points for Canadian experience of spouse, you can leave their Work history section blank. It is your choice - CIC cannot force you to necessarily claim those points.

Does it mean that's its isn't mandatory to fill the spouse 's Canadian work experience since I'm not claiming the points?

Yes. But it is mandatory to mention this in the Personal history section post ITA - you won't be asked to upload any supporting documents there.

Can I still remove from work history and put in Personal history after ITA as I have entered the experience in EE application.. but no points were claimed as it is non Canadian work experience of my spouse.
Thanks for your inputs. :)
