Job Offer........
Pre-Assessed..
Dear Forum Members,
Greetings!

This is in reference to my wife sponsorship to Canada.

I am a Canadian PR holder living outside Canada and have plans to permanently move to Canada in May, 2019.
As I got married after my PR, my wife still does not have one and I can not apply for her until I move permanently in May, 2019.

Therfeore, I'd like to confirm can I apply Tourist Visa for her so that she can accompany me to Canada in May,2 2019 (I know its hard to get it approved but I am relying on the fact that She has USA 10 years multiple entry tourist visa, and strong travel history if this can help).

Once she is in Canada with me, I want to apply her PR application and along with it open work permit, so that we both can quickly get on our track and start family together.

I would be very thankful if you can guide us and lead forward.
Thank you.

Warm Regards,
Abhimanyu Sharma

You can try but given that her husband is a Canadian PR it may be difficult. It could take a year to get approved for PR and some provinces have a 3 month waiting period to get health coverage make sure you research health coverage before getting pregnant unless you want finance your own medical costs. You have to work 600 hours the year before to qualify for maternity benefits.

It slo looks like you have given yourself almost no flexibility when it comes to meeting your RO. If your job requires international travel that could cause problems and if you have a family emergency or want to go on vacation you may not meet your RO.

Thank you Canuck78 for your reply.
I understand that for the benefits, I have to have atleast 3.5 month of regular job which I will try to find.
But, what I am planning , is it possible? Can my wife travel on tourist visa with me and there I can apply her PR and open work permit in parallel? Is it considered by Canadian Governement?

Yu are right. It is going to be hard situation.I got PR in May 2016. However, for landing I stayed in Canada for a Month April, 2016. Not sure if that 1 month will be considered in my stay for RO?

Also I have plan to visit in January, 2019 for 3 weeks which for sure will be calculated in my stay.

You need to work to get paternity benefits but your wife needs to work for maternity benefits. If she doesn't work she doesn't get the benefit. They are only a fraction of your normal salary. It is impossible to say whether your wife will be approved. Is she currently employed? I would not plan on a TRV being approved. Then you will have to anticipate a year of separation. Yes your time spent in Canada counts.

Note Canuck78. Thanks for your reply.

But the one month stay in april 2016 during landing, prior to receiving PR card will be counted?

Yes 5 year countdown starts the day you landed.
Thanks Canuc78 for being patient in answering my naive queries.

But, I am little confised now. APpreciate if you can advise:
I landed on 1st april, 2016 and stayed until 30th April, 2016 (30 days). I got my PR card on 21st may 2016, valid until 20th May 2021.

I am going again in January for 22 days before I move permanent in May,2019 to complete my 2 years.

Now, do I need to complete 730 days prior to my PR card expiry date 20th may, 2021 or as per my landing date 1st April, 2021.

If it is as per my PR card expiry then I am getting around 52 days more to complete my tenure.

No you must complete you 730 days by April 1, 2021 (actually by the day before) or your PR could be revoked for not meeting your RO.

This leaves me no window at all. Because I was relying on PR card expiry date.

Are immigration officers literally counting days at the airport before we enter? I was out because some important tasks were going at home which required consistent cash flow, so I couldnt able to move to canada.

You still have plenty of time to return.

They don't need to count days. If they suspect you don't meet the RO, they report you and the onus is on you to prove that you do. You could have moved but chose not to. Big difference.

Yes Sir, I agree with you. However, I was having certain tasks to complete which took this much time.

As I will be going in January for 22 days now and in the past I have stayed 30 days already. This means lastly I can get in Canada by 22nd May, 2019 ( as my landing dtae is 1st April, 2016). Only by this way, I will be able to complete 730 days inside canada under RO. Please advise if my calculation is correct. (I know this will leave me in no window fo emergebcy leave, i ll try to get in week or two before).
