Hello Everyone,

I know there would be many people like me who had gone through or going through a similar situation like me.
It will be really great if someone can help me on my situation.
I've to file for my Spouse Permanent resident sponsorship.
"Not too sure if I should file it Inland or Outland"
So here's my story. I became PR of Canada in July 2013 after provincial nomination program route.
Before our marriage my wife was also in Canada but we were both living and working in different provinces that time.
She has 3 years open work permit expiring next year in July.
We got married in Feb 2014 in our home country (India).
After marriage and having a beautiful time with our family (went home after 3 years time) we're back in Canada (had to leave my province for her because she doesn't like mine Sad)
I have a job now and she resumed working where she was working previously.


Just out of your experience, could you please suggest should I go with inland or outland filing.
Your guidance will help me a lot. Thanks a lot in advance.

Out-land takes much less time. When can she extends her open work permit say for another three years?
From other threads it appears that out-land application is also possible staying in Canada. But that is suitable for visa exempt applicant. Inland application will be suitable for you provided your wife has extended work permit to be on the safe side. Also inland application will carry implied status hence CBSA would not bother to remove her until final approval. You can ask veteran members for a concrete suggestion. Good luck.

Might be a silly question BUT if my spouse is currently in Canada on a work permit, do we apply for inland sponsorship? It makes sense to me but I wanted to throw it out there to ensure that somebody else can confirm it lol

You have the option of applying Outland even though you are both in Canada. He would need to maintain his status, but an Outland application may be faster, depending on where he is from.

If he wants to be able to continue working, an Inland application with an Open Work Permit (OWP) submitted at the same time, would give him implied status. Depending on what type of work permit he has know, he would likely be allowed to continue working. Many IEC workers do NOT benefit from implied status.

OWP is not available for an Outland applicant.

Why do IEC workers may not benefit from implied status? What do you mean here? His work permit is with IEC..

I mean that there has been quite a lot of discussion on how IEC workers do NOT have the same implied status. You should start looking into this ASAP, because it's been debated heavily here!

After going thru multiple outland and inland threads, i'm considering Outland filing as there's a big wait time in Inland application.
I see people are really frustrated with snail's pace work at CPC-Mississauga and Vegreville office (those who had file their application before july 2013)
