Spouse Sponsor is it better to apply from Buffalo

I live in Canada, I got married in Pakistan last December I need to sponsor my wife for Canadian immigration the current status of my wife is she is American National having American passport and moved to Canada and currently living with me.

I need your advice should I sponsor her from with in Canada or should I sponsor her from Buffalo, which takes less time? Is there any legal obligations? What if they ask me to provide Medical Examination and Police Certificate can I provide them from Canadian institution?

It does take less time to sponsor her via an outland application, which would be processed through Buffalo as she has a US passport. If she was legally admitted to Canada for at least one year, via a Visitor Record, she can use your Canadian address as her residential address (regardless, use the Canadian address as the mailing address). Otherwise, she will need to use a US address as her residential address. This means that, if Buffalo needs to disburse files to expedite processing, her file will be sent to one of the other US visa offices for processing (this is a good thing so I would recommend using a US residential address anyway, even if she has one year status in Canada). Keep in mind, though, that if an interview is required, it would be held at the visa office (Detroit, Seattle, Los Angeles or NYC) that's closest to her US residential address, so you should use the Interview Preference Location form available with the US Region Specific forms to designate the office of those four that's closest to your location in Canada. (Buffalo only conducts interviews for applicants who were authorized legal temporary status in Canada for more than a year.)

Yes, she can have the medical done in Canada, and she can obtain her FBI (and probably State clearances also) by mail from Canada. There is more information on how to get the FBI clearances done and expedited at this link.

what if my wife is living out of USA from a long time, still we are able to apply from USA and what i ahve heard that you need to provide the police clearence certificate from the country where you spend most of the time in last 5 years... am i correct ??
