I got refusal today.. Under section 205(c)(ii).. What does it mean?
This is section 205,
205 A work permit may be issued under section 200 to a foreign national who intends to perform work that

  • (a) would create or maintain significant social, cultural or economic benefits or opportunities for Canadian citizens or permanent residents;

  • (b) would create or maintain reciprocal employment of Canadian citizens or permanent residents of Canada in other countries;

  • (c) is designated by the Minister as being work that can be performed by a foreign national on the basis of the following criteria, namely,
    • (i) the work is related to a research program,

    • (i.1) the work is an essential part of a post-secondary academic, vocational or professional training program offered by a designated learning institution as defined in section 211.1,

    • (i.2) the work is an essential part of a program at the secondary level
      • (A) that is a vocational training program offered by a designated learning institution in Quebec, or

      • (B) that is a program offered by a designated learning institution that requires students to work in order to obtain their secondary or high school diploma or certificate of graduation, or
    • (ii) limited access to the Canadian labour market is necessary for reasons of public policy relating to the competitiveness of Canada’s academic institutions or economy; or
  • (d) is of a religious or charitable nature.
Hope this helps!!
And did u get the refusal after ur medicals?

Yes, I have applied with my medical and it was passed within a time of 25 days. now I am waiting for my refusal notes from CIC that I have requested online which will take around 30-45 days.
To All of you who are applying for, SOWP, I will give you one suggestion after I have done all my research through CIC and lawyer in Canada
please mention that in your application this is a really important part of your application otherwise officers misinterpret your application and they think you are applying for LMIA category C41(spouse of skilled worker)

1) we are eligible for category C42(spouse of a full-time student ) / section 205(c) (ii)
2) also mention that in your cover letter you are applying for the open work permit code (C42)

Because there are many types of open work permit so we have to mention that the right category code to full fills your eligibility.
anyhow I am going to send this link for the understanding about SOWP guideline.

https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/exemption-codes/public-policy-competitiveness-economy.html
Did you add any supporting documents or not like purpose of letter, Employment letter and work permit copy

I am working in canada (closed work permit) . I have applied supouse open work permit but I didn't mention anything in work intend column but in supporting documents i add purpose of letter, Employment letter and my closed work permit. Is it ok or not because as your above discussion I think that It may be important to fill C41(spouse of skilled worker) in work intend column (form 1295)

Hi Guys. I just want to share my experience applying for my wife's open work permit. I am currently in Canada while my son and my wife are both in the Philippines. Right after I got my work permit, (I used to be on PGWP), I have my wife apply for an Open-Work Permit while Study Permit for my son (both paper-based through VFS in the Philippines). They submit their application Oct 12, 2018 and got an email to go for medical after a week. Their medical exam was done October 22, 2018. They both got their visas approved November 14, 2018 and is scheduled to fly to Canada on Dec 12. Hope everyone will get their requests approved too.

Note: We have an on-going Inland Paper-Based PR application (Provincial Nominee Program - Saskatchewan)

Hi there. Not really much were asked from my wife. I just made sure that she has my address here in Canada as well as my phone number handy. I also made sure that she has copies of my Work Permit, Job Offer from my Employer. (i have been with my employer since January 2018 so I just requested for a supporting letter from them). These documents were all submitted with my wife's file when she applied for a work permit. After the brief interview at Vancouver Airport, they were set to take their next flight to Saskatoon.

Hello! Can you please tell me whether you submitted educational documents of your wife while applying for her OWP? And did you certify them from WES or IQAS?
I am actually applying for a spouse dependent open work permit and want to know if I have to certify my o/a levels and bachelors degree.
