Thanks again @fkl.

I am confident that I am on the right path now.

Still a little confused on how to show the visa officer that I have applied for PR. I can attach a page showing our names, DOBs, passport numbers and date of application received at CIC office, Sydney, Nova Scotia.

Would you suggest if this would work?

If you meant a resident trv with your spouse (instead of a work permit), then it would take the same length of processing time and requirements.
thanks for your opinion. just waiting for her skilled job is the best option i think. i dont want a refusal once more. i am wondering how a country like canada is seperated spouse for such a long time. its nearly 3 years we were living in 2 countries...bad luck at all...

The other thing is - being on PGWP you ONLY qualify for SOWP IF YOU HAVE A SKILLED JOB i.e. NOC 0, A or B. If you did not attach evidence for that, please add that to your application right away. Else it is clear cut refusal.


Hi! Thanks for your reply. Can that evidence be a letter from my employer that says that I am employed fulltime as an Architectural Designer? It does not say that it is in NOC, although it is. Will they figure it out?

Is a letter from employer saying that I am employed fulltime as an Architectural designer enough to show that my job falls under NOC? This job does fall under NOC but it doesn't say it in the letter. And the letter does not describe my duties. It only states my annual wage and my title. The manager said in the letter that if they have questions they can contact her, and provided the contacts. Is that enough? Thanks. Now I'm worried...

1. You would have some sort of receipt for having applied for PR depending upon what type of PR program you applied for. If not just put in your name, dob, passport numbers and date of application along.

2. It might be a bonus, but for a good NOC A job - you don't require ANY proof of funds. Just proof of job should be enough.
3. Again - in the light of some recent feedback, where i have heard people saying their refusal reasons stated "no invitation letter", i would suggest its safer to include that. It was never stated as a requirement nor did I or any one i knew included any such letter and always got SOWP.
4. Yes she applies for a regular work permit application. Just in WP type, she would choose OPEN and in details of intended work in Canada write "Not applicable". If you are really conscious, may be you could additionally write "Spouse of temp worker holding NOC A job" along. She needs to attach copy of your work permit, job letters, recent pay stub may be and she should be good to go. If she has a good education in home country or has worked in the past, adding those details might just strengthen your case.

My spouse currently doesnot have any TRV for Canada. The SOWP will be her first application for any kind of visa for Canada. Would you please let me know that by applying for a SOWP, she will also be getting a TRV?
Please let me know at the earliest possible. I am planning for her to send in the application to VFS office by Oct 13th.

You are most welcome. Most likely that is not sufficient. Canada has a general rule of elaborated job descriptions, where titles mean little to nothing. It might be possible that you get lucky and the visa officer examining your case accepts that, we never know. But would you be willing to take a chance? I don't think so.

It is most appropriate to get a detailed letter that explains your duties thoroughly, the way CIC lists against each NOC code. So it clearly matches the Skilled position you say that you have. Also your salary should be in the range appropriate for the same kind of title and should definitely be above median provincial wage as listed on cic website.

My advice is to get such a letter and add it to your application with all of your personal details, so they could relate the information to the file

Sure - don't worry about trv. When you apply for a Canadian Study or work permit from any country, holding a passport of which requires visa to enter Canada, IF APPROVED you get a trv along. CIC website says that explicitly that you dont need to apply for trv separately.

In fact, the only things you would receive if SOWP is approaved are

a) A trv stamped on passport that allows you to enter and exit Canada. It's type is W-1 for worker.

b) An approval letter from Embassy called "Letter of introduction" which sorts of confirm that you qualify for SOWP. However, this itself is NOT A WORK PERMIT. It's just a plain letter with your case info. The actual work permit is issued at the port of entry after verifying all of your details by the CBSA officer.

Have u tried contacting them? I had applied to NDVO and got the SOWP in 6 weeks straight...

Hello everyone,

I had started a new thread for this, but realised there are lot of star and champion members here who know the in-and-out of SOWP

I'll get to the point

My current situation : I'm originally from India. I have a 3 year open work permit which is about to expire in Dec 2016. I have finished my masters in Canada and have been working for a little under 2 years now in NOC Code 2171 which classified as NOC A

I am planning to get my registered marriage done in Nov 2014 and help my spouse apply for a Spousal Open Work Permit in November. I want to bring her along with me to Canada whenever we get married next year(probably around Feb 2015 as per rituals, yada yada in a big expensive way Tongue). I am choosing to get her along with me on a Open Work Permit in Feb 2015, as opposed to choosing the PR sponsorship route which takes around 13 months for her to get the landed status and travel to Canada.

I have recently applied for the PR under CEC class and carefully done so, so that I do not get my PR until Sep 2015, which gives me enough time to get her here on SOWP.

Hi M,

So far so good. There are one or two holes in your whole planning.

Since you have applied for PR, you have to notify CIC immediately after getting married and add your spouse to your PR file. So timing of your application would only have been relevant if you had applied and completed PR process BEFORE marriage, so you would have had to apply for Spousal Sponsorship THEN from home country.

Also, i am not sure what you meant by registering marriage in Nov. 2014 but rituals around Feb 2015. For a person already in Canada who marries back home recently, CIC asks for a lot more proof than mere registration. This includes pictures of event, invitation card, proof of contact (chat, call logs), hotel reservations and tickets possibly of honey moon and what not. They make every effort to ensure relationship is legitimate and not just a paper marriage of convenience. Although yours is a genuine case, my point is that it MIGHT NOT be easy to REGISTER marriage in 2014 Nov, and get a work permit BEFORE the actual event in Feb 2015.

If i were in your shoes, i would apply for SOWP right after actually getting married (AFTER UPDATING YOUR PR FILE WITH HER ADDITION) where i can easily provide any / most of above listed items easily.

It would be a positive thing for CIC to see her already added to your PR file and would be VERY NEGATIVE if she is NOT ADDED there. I have seen people refused because of that.

The links you are looking at are just fine. Keep in mind that CIC India website might not be as frequently updated as the CIC international website. So timelines listed on international one are most up to date and reliable. Though documentary requirements specific to India might be more comprehensively listed on the local embassy's website. You would use the same forms as those of a work permit and choose work permit type as "Open work permit". In case of employment details in Canada you would write "Not applicable" (better to write SOWP of a Skilled worker) and attach your work permit and JOB PROOF (very important - attach a detailed letter from employer proving you have a NOC A job) since you won't have or need an LMO which already qualifies your NOC code. Also attach some evidence of her profile being added to your PR case with her SOWP application.

Hi,
I want to apply for spouse open work permit,

My spouse went for upfront medical exam and doctor asked for the category type, when she said open work permit than doctor asked her for job letter from Canada.

Then doctor told her you can apply for medical test on a visitor visa category. Is that okay..? I want to apply for spouse open work permit

But for medical exam doctor said that I writing your category as visitor visa and not open work permit since you do no have offer letter from Canada employee
