No son from my previous relationship 11 years ago before married
If he is your stepson, you basically cannot sponsor him (possibly some exceptions if adopted and you have custody / the mother passed away or similar).

But if it's your natural son (by blood, therefore not your stepson, just your son), then he could be included as your dependent or sponsored later (but make sure to include as your non-accompanying child).

If you didn't include him in the previous sponsorship (that was rejected), you may have a serious issue and be unable to sponsor him. This is a question that you really should discuss with a lawyer because it does raise some serious and uncommon issues, that I doubt anyone here could answer.

Ok he is my biological and we included him in the previous rejected file as non accompanying I think we will do same because we want him to finish school here first

Ah, that's straightforward enough then. (If/when you do sponsor you'll have to deal with custody etc but that's a complication for later)

To prove your marriage isn’t for immigration benefits, provide evidence like photos together, communication records (texts, emails), joint financial documents (bank accounts, utility bills), and affidavits from family and friends. Travel records, proof of cohabitation (lease, bills), and any children or family planning documents also help. A personal testimony from your spouse explaining the relationship will further support your case. This all demonstrates the marriage is genuine.
It is way past that point.
