I am from saint lucia. My husband and I got married in June(in saint lucia).He recently obtained his PR in February.We are now in the process of putting in an application for Spousal Sponsorship. NOTE: i applied for canadian visa 2 years ago and it was denied. what is the best way to go about spousal application and will the fact that i was once denied visitors visa affect this application

I don't really understand your question. if you are applying for spousal sponsorship, then there is no income requirement. if the sponsor wants to sponsor a child, then there needs to be proof of a relationship that is valid for sponsorship.

I am a US citizen living in Toronto with my Canadian boyfriend, and I cross the border every week to work in the US.

A year from today, we will officially be "common law" partners, and will start our application for sponsorship.

Despite living in Toronto, can I still apply from the US? Because I will need to be unrestricted to cross the border, and also we want the application to be processed faster (from New York).

Yes - you can apply outland. In fact as an American it makes most sense to apply outland.

Note that what you're doing right now is a bit risky (crossing the border daily to go to work). There's always some chance you may be refused entry or told you can't keep crossing back and forth this way since what you're doing is effectively living in Canada instead of just visiting (and you're not allowed to live in Canada). Make sure you have a plan (e.g. someone you can stay with temporarily in the US) in the event you are ever refused entry.
 
Well when I come in each time, I tell the officer that I live in Canada with my boyfriend, and they still let me in, no questions asked.

I thought that I was allowed to live in Canada as long as I did not overstay my visitor's visa- and how else am I supposed to apply for Canadian immigration, since we are a "common law" couple, thus living together?

No, a us citizen can NOT "live" or "move" to canada without the proper authorization (PR, work or study visa). As you are admitted as a visitor when you cross, you are only allowed to "visit". you definitely are lucky you have not had any trouble crossing the border frequently, especially telling them you are living there. Perhaps because you work in the US, they are not as concerned. Just be aware another poster recently mentioned that her spouse was limited to only visiting 3 days a week because of traveling accross the border regularly to work in the US. It all really depends on the border agent you get i guess.

PS. in regards to your previous post above, ALL US outland applicaitons are processed in Ottawa. The only visa office in the states that handles spousal applications right now is LA, and files generally only go there if there is a problem with the application, ie: red flags. It is by far MUCH faster to apply outland, as it's currently taking 6-10 months to complete.
 
Hey guys, its Alex here again, wanted to ask you about CIC client status check update, we got passport request on June 26, 2014, sent it out June 40th, 2014 letter states within 45 days they need to receive it, how long do u guys personally think it might take and also CIC status check still say the same Application and Meds received, when it will be updated (since its been down for the last week or so)), what do u guys think about that>)).

I just want to ask, what if I just got married and want to add my wife in my application? what are the steps that I need to do? do I need to include her processing fee when I submit her additional dependent to my application?

Also, we are married but it is not legal in Canada. Do I have to apply as Conjugal stating that we are married, but not valid in Canada. Or can I apply as married since we are and then state that it is not valid in Canada?

Why is your marriage not valid in Canada? You'll have to explain this before we can provide further advice.

Hi, i am a filipina married to Canadian. We got married last yr and apllied for family sponsorhip. I have 2 kids with my previous relationship but we didnt get married. My x never supported my kids and i am a solo parent since we parted ways many yrs ago. Now he is married too. Immigration sent me an email to ask my x sign the IMM5604. But he refused to sign it. I went to DSWD in our goverment to discuss the matter. But they said, under the Philippine government I can take my kids with me in Canada. My kids are under my name not his. Kids are now 8 and 10yrs of age. The DSWD told me to send the form empty along with my letter stating that i have already discussed the matter to them and they said I donot need his permission to take the kids with me in Canada.If i send the form back empty to the immigration will the immigration accepts that or just refused our visa. Even if our goverment said we can leave without his permission for the kids. What if the biological father is no where to be found? Will that make any difference? Or he cant be bother?pls pls help me on this matter for i only have few days left to submit the forms back to the embassy. We really do need help pls tell me what are my chances on this matter..thank you

current processing time for acknolwedgement of receipt (AOR) and Sponsor Approval (SA) is 55 days. current experience has been longer than that. CIC is currently processing applications received on or before May 8, 2014.

my husband sent papers to missisauga just three days ago, through a private courier, it will probably arrive tomorrow or next other day,,

so, they will not send notification even if they will received it on that day?

nope. the only way you will know if it arrived is from the tracking available from the courier. If there's no tracking or signature required, you will have to wait the time listed on the website.
