It doesn't matter how much proof you have, they can still refuse if they do not believe that the relationship is genuine. Appeal but at the same time, go to your MP in Canada and ask them to inquire into your case and complain about the visa officers rude behaviour. Get your parents to go to their MP and do the same.

If you want to apply again or your appeal is refused, I suggest you order your CAIPS/GCMS notes to see exactly what the visa officers were thinking so you can correct that. I do not think that getting re-married will help in any way.
Hi Leon ,

Is it possible to bring my wife to Canada through some other means. Like getting her a job letter - work visa. Or If i can make her a Student and apply her as international student. I know they will not give her visitor visa since she is married to me and denied Immigration. Her passport has my middle name . And she is married with me according to Indian law.

Also , I found somewhere online that I could email program manager for Immigration of that department telling them to reconsider my case. Provided I have strong evidences other then what I presented. I might as well try that nothing wrong in trying.

Since my local MP is not willing to help. Also, I read somewhere If I could find leader of opposition. Even they could be sort of help.

Any suggestions ?

I will let you know outcome of each.

Thanks for your all your suggestions till now. You are one of the most senior and knowledgeable on this forum.

Hi,
I just want to know how will the Manila embassy going to contact me about any additional requirements, interview or repeat medical? Is it via e-mail, or post mail, or phone call on landline or cellphone?

Are they going to contact me on all those types of communication or on just one? Like phonecall only.

Advance Thanks for the reply.

thanks a lot leon for your information, and as you have suggested i am postponing my marriage for the time being so that i can land there and then come back and marry
kindly inform me about the following:

1.once i receive the visa stamped, and lands in Canada, for how much time do i need to stay in Canada continuously so as to be eligible as to be a sponsor (when i am back to my home country for marriage).

2.for sponsoring a spouse, how much funds do i need to show in Canada?

3. in case of a dependable child (an adopted kid) is there any exemption of showing the funds there in Canada?

hope to see your reply soon,

Unfortunately, any temporary visa, work, student or visit will require her to prove that she is not likely to overstay and if she can not get a visit visa for that reason, she will also have a problem getting a work or student visa.

Try the MP of your parents and try some other MP's in your city. Google which ones are immigrants or have shown interest in immigration issues. Everything is worth a try.

I will try that alternative too.

Also If I re apply.

Will this go wrong even if 1) I get them lots more post wedding pictures .2) I have not done wedding reception yet. Maybe I can add that. (I can forget about re - wedding with rituals) 3) I am thinking to get govt IDs with the same address we will stay for next 8 months to a year till our file processes. 4) Pictures of her with my cousins wedding. It is coming soon in December. 5) More vacation pictures. 6) Joint a/c statements after I started to stay with her 7) All grocery bills and everything of us staying together. 8 ) Police clearance from same address 9) Our tickets to show we went to do her medicals together.

I will describe our story in very detail from the start till present. Considering this was my first wedding with all proofs I will collect as well as all from first application I feel I have a strong case but not sure from Visa Officers point of view.

Any suggestions or should I stick to Appeal their previous decision ?

The only reason why I am against Appeal is

It will get expensive. I will have to stay in Canada for next 8 months. I just visited my wife in april 2012. But , I do not feel like letting her stay alone at this moment. In last 2 years since my wedding I could just spent 2 months with her.

Thankyou so much again Leon.

If you want to go and spend some time with your wife now instead of appealing, you can do that. You can just apply again after you have spent some months together. Maybe the added evidence will be enough to convince immigration then.

All

I got mixed up over the weekend when trying to finalize some things and I want get some clarification:

Please confirm: For fingerprints, we need to submit both RCMP Digital Prints as well as the clearance from the FBI (My wife is immigrating from the US). I don't see anywhere in the application instructions about RCMP digital prints, but when we were at Commissionaires they told us it was required.

Quick google searches (although not always the most reliable) have indicated that digital prints are only required when asked for by CIC

Thanks in advance!

Unless CIC requests prints, you do not need to submit them.

CIC will request them when there is ambiguity about the identify of the applicant and some criminal record. In other words, if someone with a similar name and DOB has a record, they ask for the prints to verify that the applicant is not the person with the criminal record. But you don't need to submit them unless requested by CIC.

you just saved me $50 ;D

To confirm (just to be 100%) - I obviously still need the clearance from the FBI, right?

Yes. You must submit an FBI clearance letter (assuming you lived in the US for 6 months or more after turning 18).

when to order GCMS to see officers notes on file

When is a good time to order GCMS notes to see if officer is satisfied about genuine marriage and all, after the application goes into in process at the lvo?

Any guesses or experiences from the forum users?

Probably a week after the interview. By that time the notes following the interview should be entered and any decision made reflected within the notes.

Keep in mind that the notes you do receive will be 30 days old by the time you get them.
