Yes, of course you can sue CIC. You would probably lose though.

It was unfortunate what happened in your situation but was it the fault of CIC?
What do you want to sue them for exactly?

1) Service Canada for not approving your LMO? An LMO being applied for can always get denied if they deem that the economical situation has changed and that the employer has not shown recruitment efforts, isn't paying enough or could have found some Canadian or PR for your job. When you are a TFW, that is the risk you live with. You are never entitled to a renewal, they could always say no. So maybe you didn't expect it after 4 years but they are in their right to do that.

2) CIC for not allowing you to have 2 work permit applications? The difference between sending your OWP application with the package vs. after you get AIP is around 2 months so you still would have been unemployed for months.

3) EI for not giving you benefits? Sometimes TFW's seem to get benefits but it seems more common that they don't. A requirement to get benefits is that you are willing and able to take any job and even though you are willing, you are not able if you need an LMO and a work permit first. So you can complain about having to pay for it but you would have been entitled to sickness and maternity benefits.

You probably would have been better off applying outland as you are British. London is fairly fast and you would have likely gotten your PR before you even would have had AIP with inland. However, too late to change that. Just enjoy your PR, leave the past behind and move forward.

I received a letter stating I qualify as a sponsor and application has been sent to Buffalo on Jan 24.

Does it really take 11 months to process? :-X

The applicant is processed and approved, that is the next step, by Buffalo. An AOR is usually a letter from the visa office to the applicant advising them their application has been received and what they can expect in terms of processing time. Buffalo, among other offices, is inconsistent in their use of this form. Your next communication from them, in the event they don't need any additional documents or information to clarify details on your application, will be an email to the applicant requesting the pages of their passport so they can send the Confirmation of Permanent Residence.

The 11 months timeline is an average based on processing of applications for the 12 months. It is a guideline, not a doctrine. It may be less, it may be more. Chances are 80% it will be less or equal to 11 months.

Yes.

2) is this the same form that we are printing and taking to the appointment? or a totally new one that the doctor will give us?
It's a new form that the doctor will give you.

Hi everyone, I am new to this forum so not sure which is the best place for intro and background.

I will be applying for my wife's sponsorship (outland) in Feb 2012. I have collected all supporting documents, filled out forms, wedding photos, medical, and a detailed story about our relationship for the CIC. Currently, these documents are being reviewed by my lawyer who would be forwarding on to the CIC. I am from India so New Delhi Office would be processing the application for PR. I just wanted to know if there are others who have filed in Jan 2012 or are in the process of filing in Feb 2012 for outland applications. Maybe we can keep in touch and update each other on the progress. I am very bummed about the CIC Mississauga's average processing time (68 days) only to review my sponsorship part? Is that really how long it takes or its just an average. Our file is as strong as can be. So I am not anticipating unreasonable delays from New Delhi. Please let me know the timeline I should be hoping for! I am very very happy that there is a community of people undergoing the same process sharing information here! keep up the good work guys!

I am from INDIA and my wife has a PR of Canada. We got married on 25th Dec 2011 and she will be staying with me in India till April 2012.
Now i want to know if I can send my application from India itself or should i wait for her to go back and apply it from Canda itself.

She was dong labour as well as preparing for her RN exam last year but unfortunately she dint clear her exam and she will be giving it in Oct this year.
So she has given her taxes for that period.
So please advise me that what should i do in my case??
I am currently working as Software Engineer in a good(CMMI L5) organization in India.

Your wife has to send the intial application and she cannot do in any other country. She has to go back and then apply

I would advice your wife to gather all documents, complete application forms, medical etc. and mail the application to CIC Mississauga from India instead of wasting two more months without doing anything. She can let the CIC know that she plans to stay in India till April so they are note surprised to see an application coming from there.

As long as you don't live there till the entire application is processed, a normal vacation would be just fine. It might even help you prove ongoing relationship. However, keep in mind to update the CIC on the dates of travel and hang on to those tickets etc. A normal Canadian vacation is around 2 weeks. You can apply, wait for receipt confirmation and travel or hire a lawyer who would receive all communication on your behalf from the CIC while you are away.

Thanks for your advice, but these two replies havent improved my situation at all as i am still confused if i can apply from india or she HAS TO be in canad before applying.. :(

Because she is a PR, she has to be in Canada to apply and she has to be living in Canada while the application is being procesed. She cannot apply from India.
