You do not want to go to the border under these circumstances. You would need to go to a land border then exit Canada and then turn around and try to re-enter. Only people who have valid status in Canada can do this. If you are out of status then you may not be allowed back into Canada or may be allowed in but immediately issued a removal order. It's too late to restore status from within Canada. I am trying to help someone navigate through the PR process (spousal).
They sent in the PR app and it was sent back, one of the items asked for was a Police Clearance.
We tried to get that from the Indian Consulate but they denied the request bc the person technically has no status here in Canada.
Any status they had expired over a yr ago. They are married with a child.
The Consulate said he needs to get status somehow or show that PR is being worked on by submitting a recent letter. We can't supply that.
Nothing was accepted for processing yet.
So, we're in a dilemma, can't get the police clearance yet can't move ahead and resubmit for PR bc we don't have that clearance.
The Consulate will accept visitor status. Should I see if a border agent will provide visitor status for a period of time?
We're not sure how to proceed.

It doesn't work that way. He is out of status. He needs to physically leave Canada and re-enter to try to fix his status. An internal office like Halifax cannot help him or fix his status.So border agents can't just issue a new visitor status record for him? He would actually have to leave and try and come back in?

I would say that it's highly irresponsible to get into this state of affairs in the first place. I have no knowledge of internal instructions for officers assessing the LOE in that regard, but I wouldn't be impressed by the situation you describe here... just IMO.It looks like this may be my only option??

You can get a Police clearance from your local head police station in india. That PCC is accepted and usually take about a week to get. I can advise you more steps if that helps.Huge Dilemma, seeking guidance!
