Hey guys I need some advise/information.... We've gotten our AIP, waiting for my husbands criminal background from his home country. Right now my husband is working but as many of you may know the rate of pay for new immigrants are horrible, we've been talking about him going out West to work for a year or so. Does anyone know If this could affect our application? Any advise would gone greatly appreciated! Thanks
For an inland app you must be cohabiting/living together in the same house. If he moves out west and you stay... your app will be rejected. If you both move together, then that would be fine.

We would still be cohabitating, he'd be there for 3 weeks out of the month and return home on his week off work.

Please advise. I have the following situation.
I am Russian, married Canadian guy for more than 10 years (together we are for 16 years). Have kids together - 9 and 3 years old (with Canadian citizenship). All this time husband was working in Moscow and I never applied for PR (was not interested). In the same moment we were coming to Canada in 2000, 2005,2006,2008,2012 to visit my parents in law. Each time I was receiving tourist visa. 1,5 years ago I received again multiple tourist visa, used it last summer and again came with it this summer.
But in April rather suddenly husband decided to leave his job and we decided to try to live in Canada for a while and moved to Canada in July. So I had no time to apply for PR from outside Canada before we moved in (husband and children with their Canadian passports and me with my tourist visa). So everything was ok, I became pregnant again, we decided that we are happy in Canada and decided to stay here longer, and now 180 days of my possible stay are almost over. So we need to apply for my PR. But while I am waiting for PR -will I be illegal? Or I should apply in the same moment for prolongation of my tourist visa? In order I have some base why I am staying in Canada? There is small problem(or benefit) that in several days we are leaving for Hawaii and returning at 26th of Dec. From one side my visit to USA should make Canadians to count 180 days again from zero (am I right?). From another side -my 180 days finish at 5th of January but on 26th of December they can tell me - why do you go back to Canada? You should go to Russia! Have they such right?
What is the easiest way to receive PR for me?
I imagine that with kids, married term years, and one more on the way, you are I'm sure living together so that is not an issue. The thing is, you are going to the US and I don't think that starts your 180 days again I'm afraid. Generally you must apply for trv from your home country if you are from a country that requires trv which you are. You can't just do a border hop. What I don't know, is with trv are you able to do multiple entry?
Once you start a inland PR it won't be advisable to travel they say, although i read somewhere it's OK if it's under two weeks. Maybe it was on the post at the top of this forum on page 1, but when you start your PR you should have implied status and be able to stay, it's working that's a problem, but with your kids and one more coming, maybe that's not important for you?
I know some members know more, but maybe be ready to send your application immediately on your return from Hawaii. I think it's worth getting professional advice on how to proceed. You have left it a bit late! But don't worry too much.
You can also call the CIC first and ask what the best thing to do is. You have nothing shifty going on and nothing to hide. You might want to ask about pros and cons of inland/outland for you. If you are a stay at home mum I would go with inland. That way if they require interview you won't have to go to Russia for it.
Does your husband have work lined up here? Do you have some evidence, property or a lease with both your names on it from there? Barring that there is always DNA tests for your kids if they don't trust your evidence and they can't argue with that! Hope you will be happy here. Where would you be living? What city/town I mean

Toutesweet, thank you very much for reply.
Yes, I have multiple travel visa for 3 years. I can enter many times with it.
Actually I wanted to travel after I apply for PR. I wanted to visit parents in Russia for at least three weeks in summer and to go to tropics for Christmas. But certainly I can wait for 1 year if it is necessary condition.
Unfortunately we have nothing here yet. Husband is Canadian, but he was not resident because of long-term living abroad, so we bought the cars on the name of his parents and our condo also belongs to his mom. I have account in bank. Our children go to local schools. Husband is not going to work right now (we have enough savings). Is all this bad?
DNA test? But kids received Canadian birth certificate and Canadian passports not before our entrance here but in 2004 and 2010!
We are in Vancouver:)

I don't see that it would be a problem. You could always call CIC to check with them, but you know, work is important! If he has that job lined up and that opportunity. I don't see why it would be an issue, but they may possibly have a percentage time or something. I imagine you don't intend to have this as a permanent situation. Surely there must be some leeway.
What is your timeline anyway?

I would suggest outland. For strong applications, Moscow can be done within a year, which is faster than inland. I don't believe you'd need an interview, given your strong history.

Your kids shouldn't need DNA tests, that's generally for those who are sponsoring their kids as well. Include their birth certificates and/or passports (copies of course) in the application.

Your husband does not need to be working, he just needs to prove to CIC that he (and you) will not go on welfare. If you have savings and a plan for the future, then you're fine.

Удачи!

We already can t apply outland, because we live in Vancouver, have condo here, all clothes and stuff. Children are at school, at sports. I can t leave them alone here and can't take with me. At the end of March is my due time, so since February I will not be able to travel and after birth of child too (time for preparation of docs and to recover). So the only one possibility is to apply inland. But I worry how legal will be my position in Canada when 180 days will be over? And will they let me enter the country after Hawaii?

You CAN apply outland. Outland describes where your application will be processed (Moscow), not where you are physically living. Since you have multiple plans to leave the country for vacation etc., I don't think it's advised that you apply inland (BTW processing is I think longer than 1 year in Vancouver). They may consider your application abandoned each time you leave. Look at Leon's post -- the very first post on this thread. Also, you're highly unlikely to be called for an interview given that you've been married for so long and have multiple children together.

Don't worry. I don't think it will be a problem. Your kids are registered. You are established. Condo in his mum's name is not a problem. You can include a letter from her if necessary. You can apply to extend if necessary but CIC should be able to advise. I do know a couple with kids who were given notice of deportation for husband and were interviewed which is why I'm not cavalier about the strong application. It can happen. But if you are applying inland I believe you have implied status to stay until your application goes through. I still think you should call CIC and ask. Then maybe they are OK for you to apply whenever before you go to Hawaii so you have a little peace of mind. Did your husband by any chance register you as his wife at the embassy in Russia when you were living there? I have a lot of expat friends in SE Asia that have no intention of leaving any time soon but did that in case of emergency. Worse case scenario you have to get an immigration lawyer to intervene, but that's very unlikely. You shouldn't need it. Just talk to them to be clear, and no panic.

We are living in Canada and have applied Outland. It wasn't a problem .To keep legal status in Canada during processing you just need to apply for a visitor visa extention which is usually granted. We have done this twice already.

Question about OWP..how quickly do you get implied status from sending this in? (with inland app).
Do you need to apply for extensions if you send this in?
