You don't have to have a full time job. Students have successfully sponsored their spouses. They DO have support from family and/or student loans. They don't have a need to rely on social assistance.

I'm waiting for my file to begin processing.

my medical for my application for spousal sponsorship has been done , my question is the DMP gave me only the copy of up-front medical notification with
UMI: numbers , name and birthday. so can I attached this medical notification instead of the Client Biodata Summary ( IMM 1017 ).

I am a permanent resident of Canada and came to India for marriage and didn't went back for 6 months. But now my wife is 3 weeks pregnant. I don't understand the procedure now. Can i apply for my pregnant spouse for PR in Canada. I want the birth of my child in Canada if possible.
If not, than i will have to wait back here in India. Normal processing time is 10-11 months. Is there any chance, if embassy can consider it in a special case and cooperate by immigrating my spouse. It will be difficult for me to start all over again in Canada. I wish to go and start my business there in Canada without any further delay, but need assistance and cooperation.

Hi,

I am Canadian Citizen. My boyfriend is an international PhD student who had been living in Canada under Study Permit.
We were together since 2009 and moved in last September. He applied for Canadian Experience and FSW PhD stream and got rejected for both of them because of the fact that the officer did not accept the work experience.

So next will be that I sponsor him as my common-law partner in September (we will be living together a year from September 2012 to September 2013)

We have almost all the required documents, joint bank accounts, joint lease, joint property purchase, life insurance, letters, pictures from our 4 years relationship. I am just confused when does my marital status change? Does it change after we lived together for a year? So if we moved in in September, does it change next September?

1- I am filling up my tax and I am declaring myself as single. Since I am not yet in a common-law relationship right? We have not lived together 1 year... My marital status will change in September right?

2- He declared himself as single for the same reason. We thought after we live together for a year our marital status will change. Not sure if this assumption is right.

Since you are a PR, you MUST be in Canada to sponsor your wife. You can't sponsor her if you are residing in India.

Your wife will need to apply for a visitor visa to Canada. The embassy will not give you special consideration, and if anything her being pregnant makes it much more difficult for you. Since she is married to you, and is pregnant, there is a higher chance a visitor visa will be refused since it will be assumed she will not intend to leave Canada after the visa expires. She would need to show very strong ties to India that would satisfy CIC she intends to return. But if she can get a TRV, then when she arrives here you would sponsor her inland.

So your only chance, may be to return to Canada yourself and sponsor her outland. Unfortunately if she can't get a TRV, you will need to be separated for the entire processing time (except for occasional trips you could make to India). In this way, she would need to have her baby in India and the baby would need to be added to the application as a dependent after its born to also become a PR.

Your status officially changes on the date you have been continuously cohabiting for 1 year.

So if that happens Sept 2013, then you would be officially common-law for 2013 taxes, and single for 2012 taxes.

1- We got a joint credit card in 2010.
2- I added him to my Car insurance in 2009.
3- I added him to my life insurance recently.
4- But we started living together in Sep 2012.

Does these details change your answer?

I have a question. In the application form what do you write as your (applicant) status in the country if his refugee claim was recently denied. would he still be a "refugee claimant" or what?

For tax purposes none of this matters. The CRA only cares about the 1 year mark, and wont ask about any proofs or anything. They kind of go by the honour system so just take your word for it, unlike the CIC.

True that they only care about the 1 year mark, that said, they MAY ask for proof. My parents are common law, and they are Canadians and have to send proof that they actually live in the same house. So keep any proof you have JUST IN CASE.

my ecas says "a decision has been made. the office will contact you regarding this decision" but i haven't got an email yet?

i was sponsored under family class inside canada.
