Spousal sponsorship

Hello,

I sponsored my wife under the Spouse or Common Law Partner Class in Canada in June. She is currently in Canada on a study permit and is pursuing a full time Master's in another province. Although we visit each other frequently, we are unable to live together until the end of her Master's.

We got a letter from CPC Mississauga today informing us that we might not meet the requirements of this Sponsorship Class since we are not cohabitating together. We have been asked to provide evidence for the same. I think we ended up choosing the wrong Class while submitting our application.

I wanted to know what would if it is possible to change the application to Family Class. Or would it be possible to withdraw and resubmit a new application under Family Class? Just wanted to know our options at this time!

Yes, you're not eligible for the 'in-Canada' class, as you need to be living together. You can do the 'outland' (regular family class, there are options for applying in Canada within that).

You could certainly ask if they would be lenient and allow some kind of switch - but formally there is no such process and I don't know if they have the authority to do so. If you go this route, you will lose the application fees (but I don't believe you'd lose the 'landing fee'). I have no idea what the chances are. If she's refused on this basis, it won't impact a subsequent application.

Or you can withdraw and re-apply.

I've no idea which is advisable. Since your spouse is on a study permit, at least there's no special urgency.

My own guess is that withdraw and re-apply would likely be quicker overall. But it's really just a guess.

When attaching documents such as Banking and other Financial statements to meet "Proof of Relationship", is it enough to show the first couple of pages (that has the names of the Sponsor and Primary Applicant on them together) or should every page of the financial statement be included? I ask because this can somewhat voluminous, including some bank-provided "This page left intentionally blank". :-/

Do you think we should mention that we made an honest mistake in selecting the class in the reason for withdrawal?

Also, during our re-application, should we mention that we did apply before but withdrew since we realized that we had incorrectly selected the Sponsorship Class?

It's been a week now since everything is completed on my tracker! But haven't seen my COPR reflected nor I haven't received the PPR.
And my gckey hasn't shown final decision yet!
Do you think I will have to wait a good long time again?

In fact just found out that we actually had selected the correct option in the check box for IMM5533, but accidentally chose the wrong class when creating the online application in the PR Portal at the very beginning. Apparently IRCC goes with the PR Portal Class but not the one selected in the actual form.

Just a heads up to everyone to not make the same mistake!

We've tried twice for the visitor visa, but both times were refused for the typical reasons (officer doesn't think she'll return, not strong enough ties to her home country etc.). We want to apply for a visitor visa for a third time before we get married. Would this be a bad idea given that once we're married we plan on applying for outland family sponsorship?

Like a better job, bought a house, any other financial or career changes that will help the officer answer to their boss - that the applicant will return back after the TRV expires. In the current climate of refusals and cutting TRV, its better just to avoid the third refusal.
Better focus on collecting all the documents, collect all your evidence from the past 3 yrs or whenever you had the relationship...build a strong case...study the Application guide on cic website. Collect all the pics and receipts for everything related to marriage ....and then just apply. Some people are getting their Spousal PR within 4-8 months ...while some are waiting 20+ months - regardless of their ethnicity or country of origin.

Nothing has really changed with her financial situation and we know the likelihood of approval is low, however we thought we'd give it one last shot. I'm just not sure if it would hurt her PR application or have no effect at all.

Her chances are likely better on the after-married 'family reunification' angle, where a visa app will be normal. (And a refusal then will likely not affect her spousal app, if it comes to that)

There were certainly press releases. I don't recall more than that, probably there was.

Given that we've had a three year relationship with extensive evidence, would it be wise to apply for spousal sponsorship right after we get married? Or should we wait a while?
