Nope, no problem with that. My husband stayed in Canada the entire time his outland application was processing (7 months) and we had no issues. Just make sure that if you want your spouse's CoPR to come to your house, put your address on your spouse's application otherwise they will send it to their US address.

Thank you so much for clarifying this. Just out of interest, how did you spouse manage to stay in Canada when one has to exit the country after a six month visitor visa period. Did your spouse have to cross the border or anything like that? Just wondering as it's always best not to overstay over 6 months.

1. You don't need to sponsor the child. Your husband's sponsorship app continues as is, just inform the VO of the child's birth.

2. You will need to apply for the child's Certificate of Citizenship and Canadian passport.

3. Yes, the child will need a passport and you will need a letter of permission from the father.

My husband applied to extend his visitor status online once his first 6 months was up.

Hi I have a question to you guys, I landed here in Canada January of this year under TWP, I met my husband(french canadian) during my first day of work. Then we were on dating for 2 mos only and get married in April of this year. I resigned from my job since my employer did not give me enough hours as stated on the contract. We moved to Yukon to take care and do the maintenance of my husband's property since it's for sale. I am not allowed to work anywhere in Canada as it was stated on my work permit, Now we are planning to process the spousal sponsorship, My question is, Is it possible for us to process the spousal sponsorship at this time? since the length of time that we spent together was literally short and I just arrived here this year will it be possible to be approved by the immigration? or do we have to wait few more months before we process the application?..because I want to work, I want to apply as well for OWP. I just feel frustrated because there were a lot of job offers but because of so many restrictions on my permit (LMO) I cannot do the job. If anyone here had an experience like me or for those people knows what to do, please please I need your opinion about this. Your response is highly appreciated.

hi icee_chic,

I believe you should be fine as long as you provide substantial proof of your relationship and properly document how you met your spouse, details of the communication between both of you (chat, email, phone records). In addition, you will have to clearly provide information about your marriage, provide photos, and provide details that they require as supporting evidence of your relationship.

If all goes fine, you will qualify for permanent residence on condition that all is smooth for two years. In case there are any issues during this time, CIC can deny your right to continue with your PR. This was introduced to recently as a measure to ensure authenticity of relationships.

I doubt you should have any other issues but then you will have to decide whether to apply inland or outland. Outland may be faster for you, if you qualify for that. Discuss it with your spouse.

Aww thank you so much! Yes we decided to apply inland instead because my working permit will expire in 2016 and I cannot go outside Canada unless there's an emergency back home but the catch there is I don't have any idea if they will still allow me to enter in Canada since I resigned from my employer. Anyways, I think its Ok for us to process inland instead since I am also processing for my credentials to be evaluated as a Foreign Nurse here and it takes time to have it evaluated. Because if it's outland I need to wait for my permit to expire in 2016 before I can go outside Canada.

But...if your work permit doesn't allow you to work for another employer, it doesn't really matter that it expires in 2016.

Perhaps a more important question would be: Does that work permit still give you a legal status in Canada, even though you haven't been working?

Yes even if I am not working, my status right now is still legal as a worker until 2016.

Out of curiosity, why can you not leave Canada until 2016? If you get your PR, you can work anywhere so it doesn't matter if your work permit hasn't expired yet cuz you wouldn't need it anymore.

I have no idea what is going on and why.

I am very happy that my spouse got her VISA today.
It took less that 10 months to get the Family Sponsorship VISA. I did all the documents by the book. Everything was paid on time.
She is from Bulgaria. The papers were done in the Canadian Embassy in Romania.

The very, very strange thing is that she has to enter Canada before Jan.08,2015. This is not even 3 months or the normal 6 months for sponsored spouse requirements.
I have no idea if it is wrong or right but just posting the information.
For sure now there will be a lots of running around, a lot to prepare the move but do you know anyone else with the same situation ?

More details to come.

Good luck to all with the crazy Immigration process for coming to Canada.

While you are currently legal in Canada, you are correct that it would be difficult to return to Canada if you ever left if you are no longer employed with the company listed on your work visa. This is true no matter if you applied inland or outland.

If you apply inland and submit an OWP along with your application you should get the open work permit after 13 months. Then another 8 months to finish processing so 21 months total. During this entire time, you would not be able to leave Canada for any reason, even if there was an emergency back home. If you couldn't return to Canada your inland PR app would be cancelled.

If you applied outland, since you have valid status in Canada for at least 1 year you can request CPC-Ottawa to process your outland app based on your current residency in Canada. In this case any potential interview would be in Canada, so no need to ever leave.

HOWEVER there is no guarantee that CIC would follow your request, so there a chance your app would be sent to your country of citizenship (I think you're from Philippines so through Manila office). But even if this happened you could still stay in Canada during the entire processing time with your current status. An average app through Manila takes around 12 months total.

Applying outland through CPC-Ottawa seems the preferable choice for you, however the big risk is if your app is instead sent to Manila and you are called for an interview there. Then you would need to leave Canada, and would need to stay in Philippines until your PR is approved. The chance of an interview is usually very small, BUT it looks like you had a very quick relationship followed by quick marriage, which is a red flag for any application.
