Leon,

After seeking advice from a Immigration Lawyer I have decided to change my PR application, that is almost ready to send from Inland to Out. I am a New Zealand citizen being sponsored by my Canadian spouse and we decided to take this route mainly because of the wait times for Inland at the moment. My question is, for IMM0008 under "Current Country of Residence" will I put Canada or New Zealand? I have been travelling between Canada and New Zealand for about 6 years and my last entry was March 2014 which is when we began this application process.
there is no issue at all putting a canadian residence in an outland application. as long as you maintain legal status, you are allowed to be in canada while an outland application is processing. if you plan to be in canada until approval, then use your canadian address for your correspondence so your approval papers will be mailed to you where you are. if you plan to go back and forth, use the address you think you'll be at more. good choice going outland since you are from NZ. you will for sure find the process much shorter than inland.

oh and also, don't get worried if you are told by cic your application will process in ottawa or mississauga. both offices are currently processing "uncomplicated" files from the Syndey visa office, which is where i believe NZ applications are processed.

Hi,
I am a June 20, 2014 Inland Applicant, AOR received last August 8th, I have just received my newly renewed passport.
My old one which I have submitted to CIC together with my application is not valid anymore since it has been punched.
Do I need to send a copy of my new passport to CIC? If yes, in which address thru email o mail.

Hope somebody will answer me, thanks a lot!

IEC visas unfortunately don't benefits from implied status which means you'll need to stop working as soon as the IEC expires. Your only option to keep working is if your employer is able to obtain an approved LMIA which would allow you to apply for a closed work permit tied to that specific employer. To continue working without interruption you would need to have the closed work permit in hand before your IEC expires.
Thanks for this response. Unfortunately I can't get an LMIA as I'm self-employed. But if I manage to extend my IEC visa, would this not help bridge the gap whilst waiting on my permanent resident status? It wouldn't be so much an 'implied' extension but rather an actual validated extension (assuming this application is successful and I get the extension)...

I'm not sure I understand how you are planning on extending your IEC visas. IEC visas cannot be extended (i.e. it's impossible to apply for an extension for this class of visas) and even if you were to try, you wouldn't get implied status and would eventually just have the extension refused. So it's a non-starter right from the beginning. Your only options for continuing to work is either the LMIA route (which you've already indicated isn't an option) or to obtain a second IEC (if you qualify). If neither of these are an option, you should apply to convert your status to visitor before your IEC expires and then stop working as soon as your IEC expires.

Dear seniors,

I am a PR holder in Canada and will be getting married on 14th February 2015 (yes, Valentine day). My wife has a multiple entry Canadian visitor visa and our plan is that she will accompany me on 01 March when I return to Canada. We have already started filling forms (Sponsor and Applicant) as available in CIC website. Our plan is to apply as an outland applicant (NDVO) immediately after we arrive in Canada.

My question is "should we show in the forms especially in Sponsored Spouse Questionnaire that she is with me in Canada on visitor visa on the date we submit our application to CPC, Mississauga? Hope it will not complicate the case.

Your comments will be appreciated.

Thank you,

if you're asking if you should omit the fact she is currently in canada as a visitor when you send in your applicaiton, the answer is no. if she plans to be in canada for the entire process as a visitor, then she's going to want to put her canadian address as a point of contact, because that is the address CIC will use to send her communication by mail ie: her visa. It is perfectly acceptable for an outland applicant to be IN canada when the application is sent in and being processed. she entered the country legally and has every right to be a visitor. Where she is in the moment her application is submitted or being processed is not going to negatively affect the decision. the only "risk" is if she is called for an interview, she will need to fly back to her home country for it.

Has anyone here had any experience with an immigration lawyer/law firm that they could recommend? My boyfriend and I are opting for a layer. We are located in the Ottawa area and so far have only found one lawyer who does offer but doesn't specialize.

Based on your previous posts, yours is a pretty straightforward common-law case for a US citizen. Most people here will strongly advise AGAINST using any lawyer as you should be able to put together the entire application package yourself and asking any needed questions to this forum. Most US applications get processed with little scrutiny.

Unless you have an extra $3000 or so lying around that you just really want to give to someone.

Hi rhcohen2014,
Thanks for your comments. Although published processing time for NDVO (New Delhi/India) is 15 months, but I see from the forum that a good majority of cases are being completed in 6-8 months. Our plan is to buy a return ticket with maximum validity of 6 months and she will return to India to get her visa. We want to reduce the separation to bare minimum. Should she mention Indian address or mine in Canada?
Cheers..

well since you just said "she will return to india to get her visa", then i would suggest she put her indian address. again, she should use the address she intends to be at during the application process and at time of approval.

Hey guys, I was wondering if the online receipt printout needs to be filled out. I paid the sponsorship fees online and the receipt has areas to enter client date of birth, address and phone number. Does this need to be filled out? Thanks!
