It was originally a refugee claim that became a spousal application as well. There is actually a policy ("Public Policy") that literally states what I just said (CIC IP-8, page 65 in Appendix A See: http://www.cic.gc.ca/english/resources/manuals/ip/ip08-eng.pdf):
"
Note: As a general rule, CIC should accept only validly issued and non-expired passports for the purposes of the grant of permanent residence in R72. This having been said, the use of a passport which has expired during the processing of an application may be appropriate to fulfill the R72 requirements when no identity issues remain. “Lack of status” does not refer to any other inadmissibilities including:

- failure to obtain permission to enter Canada after being deported.
- persons who have entered Canada with a fraudulent or improperly obtained passport, travel document or visa and who have used the document for misrepresentation under IRPA.

It's not an issue. It's not your fault it expired, as CBSA seized it. You cannot renew without it. Therefore, their problem.
I agree with you @profiler. IRCC will be the one requesting it. They dont expect you to do anything about it if it was not in his possession.

It's actually written into the public policy. Providing there is no identity concerns, they can use the expired passport in a pinch...

It's possible. But it's also possible that it's from the previous glitch. You may want to call to ask for a status update.

I called CIC,the agent mentioned the file is still in process. If they need more documents they will reach out to me.

I really hope so. Right now I am in such a position. I don't how to react. I'm really desperate to go see my parents whom I haven't met in 4-5 years as they not doing good health wise.

Oh yes application received on both sides

I suspect they will start working on it soon. And if they have everything (and the medical is already approved) they may approve the file the same day.

Since couple days I'm trying to call cic but every time saying we are unable to transfer you to agency.Maybe I called them 4-5 time never answer
Do you think is this normal?
