Does the Police Clearance Certificate (PCC) request state Canada, or request for fingerprints? It's unlikely that's it's necessary. But if they requested it on the letter you received, then you should do it.
Thank you for reply.
No it doesn't say Canada and there is no request for fingerprints. it only says the following

1. Country where you currently live, if you have lived there for six month or more
2. There country where you have spent most of your adult life since 18.

I spoke with cic agent and she was confused too. So she advised me to submit my home country clearance first and meanwhile wait if they request Canadian. I've looked at RCMP website and it seems quite a process. Does anybody did RCMP clearance by any chance?

I plan to leave the country after I receive my OWP (should be sometime in Feb), managed to push back schedules (I was supposed to leave around this time).

However, I have read up a case where someone applied for a TRV back at home after returning home and it was rejected (canadavisa.com/canada-immigration-discussion-board/back-to-zero-againpls-help-t254424.0.html). The issue is that I assume he doesn't have a multiple entry visa? So you have to 1) apply for a new visa 2) pass through the border, and I would assume that the first part is the harder one.

Hello Everyone,
I hope someone can help me on this one. So I sponsored my husband inland back in November, we sent in an app for OWP as well. His current status is visitor (valid until September 2017). However, he has to go back home due to family reasons, I'll be joining him as well later and we plan to come back together in a couple of weeks. However, he doesn't have a TRV (his old one expired when his work permit expired back in September). We plan to apply for TRV from out of Canada (since you need a WP or SP to apply inland for TRV). Also, would it be an issue if I were to make an invitation letter for him as his wife? And say that I am inviting him for a visit since it will be a tourist visa because it is from his home country. Is an invitation letter required?

Just wondering what anyone's experiences are in this situation? Will there be an issue of us leaving the country for a couple weeks only given that we have a sponsorship app in progress?

Thanks,

mars

Playing devil's advocate here: The problem is managing "Dual Intent". They will know there is a PR application in play. So, what CBSA needs to know is that, the PA will abide by the laws of Canada. If they are not approved, will they go home. What's the draw to go home. So, bring proof of family ties, financial ties, property, etc etc.

Funny story: My wife was told about needing to be truthful, no matter how it may look with the CBSA. So, her last time through Pearson's CBSA desk, they asked why she was seeking entry into Canada. "To be with my husband." Brought her dog and everything. She was escorted into the little room where they started typing out her answers into FOSS/GCMS. Everything she said was recorded. They did indicate to her that "You cannot just file an application and stay, that's not how it works." They tried for about 45 minutes to trip her up. They then stamped her passport, and wrote in a date 6 months - 1 day from the date she entered, and let her go -- no inspection of the dog or luggage.

The moral: Bring evidence with you that a PR application has been filed, an OWP/SP/WP if the PA has them, and proof that there is still ties home. The reasonable expectation is, if OP is able to convince the officer at the time of entry that they will return home if an application is refused, they should permit entry. But there are a lot of factors they consider when permitting entry...

Thanks Profiler for your response. I've read up a lot on "dual intent" and how to apply it. The thing is, he already has visitor record in Canada, he is allowed to stay until September 2017. The visa will be issued overseas but we were thinking of booking some return flights to show that he will leave after September 2017. I guess when we come back, we will have to be careful in regards to what we answer at customs.

Date modified has absolutely nothing to do with your case. I know you want the hope, but it doesn't.

Usually there is a country list. Canada doesn't technically need to be included, as they can check with RCMP for you.

Sage Advice Here: Ignore the Date Modified. From what I have discovered from reading, they are probably spending an hour per case looking at evidence. There is a high likelihood that they have not even looked at anyone before August 25 2015 as of right now.

So, Stay on Canadavisa.com and answer questions, or loiter, but try not to dwell on what your case is doing. I think I projected 7 weeks for you -- so check ECAS in 7 weeks. I bet there will be a present for you then...

no, we applied inland he lives in Canada and we live together. He has been in Canada for 4 or 5 years now (student at first and then work permit). But his work permit expired in September 2016 and so he had to do restoration of status to visitor (valid until September 2017), his visa also expired at that time. We applied for OWP with the inland sponsorship app back in November and should get the OWP in end of Feb or March. But he has to go back home earlier than that. That's where the issues come. He can't apply for TRV from within Canada because he doesn't have valid WP or SP, so the other option is to apply for TRV outland. It's a bit of a complicated situation.

Carol, I spoke with cic today... a very polite girl told me that I'm going to have news from now to the end of March... everything is fine with my paperwork, and they are going trough 2015 in full speedy.

Let's wait a little bit more... go go go 2015. Because 2016 is getting nervous.
