Im confused but for future reference, is the financial criteria waived since we are married? I found this info on canadavisa.com and not on the cic site. I thought I had to show proof of income to support him for three years. Please help me out when you get a chance.

What financial criteria must be satisfied to qualify as a Sponsor?

5.To qualify, the Sponsor must be able to demonstrate the financial ability to provide for the essential needs of the Sponsored person(s) and any accompanying dependents. This requirement is waived if:

* The person requiring sponsorship is the spouse, common-law partner or conjugal partner of the Canadian Sponsor; or
* The person requiring sponsorship is the dependent child of the Canadian Sponsor.

8. What if the Sponsor does not have the requisite financial ability?

If the Sponsor does not have the required financial ability, the spouse, common-law partner or conjugal partner of the Sponsor may act as a co-signer to the undertaking. In such case, their combined financial abilities will be assessed, and the co-signer will be equally liable in case of default.

If the combined financial abilities of the Sponsor and the co-signer still do not meet the minimum requirements, then the Family Sponsorship Application will be refused.

The financial ability requirements do not apply if the Sponsored person is a spouse, common-law partner or conjugal partner or a dependent child of the Sponsor.

If the person you are sponsoring is your spouse, the financial requirements are waived, don't worry about them.

Hello,

Where do I find that info, I dont think its mentionned on the CIC website. I found something on a canadavisa site I posted what I found. So do you know what it takes exactly to sponsor a spouse ?

I think the requirements are that you must not have a child support judgement against you, or a previous undertaking (sponsorship) still in effect. You must also not be an undischarged bankrupt, or be receiving welfare. Other than that, the income requirements are waived, you could declare an income of zero for the last tax year and it would still not be a factor.

That being said, it's the spirit of the undertaking that counts, you are still expected to help provide a home, food, clothes, and take care of any medical needs. So you will want to show that you are willing to do this.

That's great, as for what you mentioned none of the above applies to me such as receiving child support etc.. but do you know where this info can be found ? Thank you for helping me out with this. :-*

As for child support judgment, they simply mean receiving child support correct, silly question but :-X

No it is OK to be receiving child support, what is not ok is to have a maintenance judgement against you, IE you were taken to court over child support, the judge made a ruling saying you had to pay X amount of dollars, and you have not paid it. I actually missed a couple barriers to sponsorship which I will list here,

From CIC Operation Manual IP 02

Table 15: Ineligibility for sponsorship

Sponsors and co-signers cannot sponsor if:
1. They are permanent residents subject to a removal order
2. They are detained in any penitentiary, jail, reformatory or prison
3. They are convicted of a sexual offence under the Criminal Code [against anyone]; or an offence [against the person] under the Criminal Code against a family member.
4. They are in default of spousal or child support payments ordered by a court. This includes payments ordered by a court outside of Canada.
5. They are in default of a debt owed under the Immigration and Refugee Protection Act
6. They are an undischarged bankrupt under the Bankruptcy and Insolvency Act
7. They are in receipt of social assistance other than for reasons of disability (this only applies to welfare, CCTB, ODSP, Student Loans, living in social housing are OK)
8. They are in default of a previous sponsorship undertaking.

Also from IP 02:

5.33. Exception to minimum necessary income requirement The ability to meet the minimum income requirement is mandatory, unless the sponsor is sponsoring a spouse, common-law partner, conjugal partner or a dependent child where the child has no dependent children of their own. This exception also applies to persons under the age of 18 whom the sponsor intends to adopt in Canada.

Hey,

Thanks for the help, well Im not receiving any help or assitance from the Government or have any pendings against me. So, Im ok for that aspect but do I need to provide my bank statement to show them how I will be supporting him when he firsts get here?

You are still going to be responsible for your spouse for three years after they land. This bit doesn't change.

However you don't need to be making a minimum income (like you to for parent sponsorships) in order to qualify as a sponsor.

To make sure my previous answer makes sense...

The information you found on the CIC site and included in your first post relates to QUALIFYING to be a sponsor only. In other words, even if you have no job, you can still sponsor your spouse (as long as you are not on welfare, bankrupt, etc.).

However you are still responsible for your spouse for three years after they land. There are no exception made to this rule.
