Sponsorship of American Wife

Hi!
I have just spent some time reading around the boards and read the really helpful Spousal Sponsorship thread at the top of this section but have a few questions.
My wife and I were married in Los Angeles where we were both living at the beginning of July (she is American and I was on a TN Visa). I am now back in Toronto where I am from and we are trying to decide which application to choose. She currently lives in Rhode Island and will be coming up to be with me starting in December while the applications are being processed. She will not be working in Canada and i will be taking care of the both of us, we just do not want to be apart.
From what I gather:
-If we apply from within Canada the processing time is longer and it is not suggested that she leaves the country until she gets her PR.
-If we apply from the US it will be easier for her to travel back an forth and the processing times are shorter.

So at the current moment I am thinking that we apply outland, but have a few questions.

1)Being in Toronto we are very close to the Buffalo office, but i do not see any info if this office has closed due to the strike. Anyone have any information on that? (If Buffalo is out of the question, NY is close by plane if she needs to attend and interview)

2)If she is with me up here, is she only allowed to be here for 6 months?

3)Neither of us have any past criminal records, have never been in another marriage, nor have children. We have mutual friends have photos and proof of of us in our time together, our wedding and we both know and have stayed with each others families. Should this make the process go a little quicker?

4)Is there anything else that should be on my radar if we apply outland and she is visiting with me in Canada during the processing time?

Oh it's closed all right. Your circumstances may not decrease processing time, but certainly may alleviate the requirement for an interview. From what I have read on this board, ALL interviews are in LA. If she's going back and forth a lot, I highly recommend getting a NEXUS card. Yes, six months to start but she could get a 'visitor record' and apply online to renew/extend her TRV if she hasn't been back and forth since initial entry into Canada.

Hello Kwaiden We have a similar situation as you. After much consideration we decided on Outland, my spouse remained in Canada as a visitor. We applied for visitor visa extentions twice already and was granted same each time. Now we're able to stay together in Canada while the application is in process, white still being able to go to the USA if necessary. If your application is straightforward, most likely the interview will be waived, at least that's what I can determine by reading this forum.
If you decide to go Inland route there are more restrictions and a longer processing time. Good luck with your application.

Hi there! I sponsored my American husband last year.
You are correct with the Outland vs. Inland processing ideas.

1) Buffalo is closed. Our application was processed through the Ottawa Pilot office. When you fill out your application you can choose which city you wish to be interviewed in (I believe it's only LA now, though?) - the chances of you needing an interview is slim for US spouses, thankfully.

2) Sort of. When she enters Canada they will stamp her passport and put a date under it - this is the date she must leave. If there is no date, it is 6 months from that time. They have the right to give her less time than 6 months, especially if they feel that she will not leave when her time is up. Just don't make it look like she is MOVING in with you.
Once she is here, you can extend her stay through this page: http://www.cic.gc.ca/english/visit/extend-stay.asp - when my husband's 6 months were up we got our stay extended via this route for an additional 12 months.
3) No one can really guarantee the timeframe. When we applied first stage took 2 months, and second stage took 5 months. The processing times posted for stage 2 at the time was 12 months - so we got processed pretty fast and we are in the same situation as you two.
4) The main idea is do not lie to the Border officers, but do not make it seem like she is moving in with you permanently (even if she is). They have every right to deny her entry if they feel she will over-stay.

If we apply outland, should we also submit the papers for an Open Work Permit, or is that only valid if you are applying inland?

Open work permit is only for inland.
