Sponsorship after overstay?

I overstayed my visa in Canada for several months (as I could not leave until I sold the property I owned there). As soon as the property was sold I left Canada and returned to the UK (I am a UK citizen). CIC were aware of my overstay.

I had a girlfriend in Canada and we had our share of problems but now have reached the point where we do want to tie the knot and start a life together.

I imagine that returning to Canada to get married is not an option as I would doubtless be refused entry after my previous overstay.

If we get married in the UK and she returns to Canada, would her application to sponsor me be hindered by my previous overstay?

Another consideration: when we first met about 2 years ago, it did not occur to us to document our relationship for future use.We do not have photos (I hate cameras) or a joint bank account, or any of the other stuff which I have seen listed as things that are generally listed.

We would have to live in Canada as she has nearly grown children from a past marriage and she understandably wants to stay close to them.

How is CIC aware of your overstay? Were you issued a removal order? If you were, then you have other steps to follow.

You have to have some sort of proof of your relationship and it doesn't just have to be pictures. Emails, chat records, cards, letters, telephone records, letters from friends and family, etc. The list is endless.

i have the same dilemma right now.my work permit,lmo and visa expired.ive recieved a refusal letter fr the cic when i applied for restoration of my working permit because my employer failed to renew our lmo. we sent an application for an lmo and as of the moment we only have a pre approval with regards to our application. i and my canadian bf were engaged for a few months and worried that i need to go home,we decided to get married.
now im too confused.our agent whos processing my papers said we can drive to the boarder and change my status as visitor and get my husband to sponsor me...were still completing the necessary documents for the spousal sponsorship....but then my former boss said i might consider consulting a lawyer coz i might just get deported if well go to the boarder...
help!!!dont know what to do....

I was issued a refusal of an extension to my visa. I could not leave until I sold my apartment. So I stayed on. CIC were aware of this due to ridiculous circumstances. A friend in the US was coming to Canada (not to see me) but when she was stopped at the border by CIC she gave my name as a contact and they telephoned me, hence becoming aware of my overstay. Daft but that's life sometimes....

What other the "other steps to follow" you refer to?

You might have to file for an ARC (Authorization to Return to Canada)
If so - they'll let you know

Thanks for your reply.

How would I go about applying for an ARC? Is this something I could do at the Canadian Consulate in London?

You don't need ARC, you weren't removed from Canada. It is only for persons who are issued either an exclusion order or a deportation order, from your posts, you just an overstay and then left.

Again thanks for the reply, however, perhaps I was not clear about my circumstance.I did apply for an extension to my visa which was refused. Plus CIC were DEFINITELY aware of my overstay, due to a visiting friend mentioning my name which lead to customs telephoning me and telling me that I should have left by now. Not sure how this affects the situation.

It really doesn't but it will just make it difficult to re-enter as a visitor.
