I am sponsoring my mother and thinking to include my spouse as a co-signer. But I am NOT sure whether she would be eligible to be a co-signer. She came to Canada in September 2013 as an international student and worked 4 months as a part time teaching assistant. So her gross income for 2013 was around $2,700 and she did NOT have any income for 2011 and 2012. She became PR in Feb 2014 (I sponsored her in Jan 2013). we are a family of 3 (myself, spouse, my mother) and my personal income meets the LICO+30% requirement for 2011, 2012 and 2013. However I don't know whether my individual income will meet the LICO+30% for the next 5-6 years, so I want to add my spouse as a co-signer.

My question: Does she meet the requirements as a co-signer since she did not have any income for 2011 and 2012 ? Any reply would be highly appreciated.

yes it doesnt allow you to type in that box if Q 17 is unemployed - than why would they give htat box and then it says please describe on a separate sheet of paper the situation -

I have question regarding IMM 5409 - is this form for everyone or it has to be filled only if the spouse is common law

I need a clarification to fill out application for my mother in law.
Checklist http://www.cic.gc.ca/english/pdf/kits/forms/IMM5771E.PDF, Point 6 and Point 7 states that
Schedule A - Background/ Decleration ( IMM 5669) and Additional family information ( IMM 5406) needs to be fill all family members.

But actually, these 2 forms states that these should be filled out by Applicant, common law partner and dependent children only.

So, forms and checklist statements are conflicting.

My brother in law in sponsoring my mother in law.

Question: My spouse is required to fill out these 2 forms or not, who is over 18 Yrs. and no more dependent on her mother. ??

As per the guide, a principal applicant's "family members" includes your spouse or common-law partner, your dependent children and any children that are their dependent children. As your wife is not a dependent, she is not considered a family member for the purposes of this application and does not fill out the forms.

No idea. CIC secures these forms with encryption and each PDF fillable box has it's own property (locked, font size, what text it allows etc.). They probably overlooked that this box is locked to end users. I tried to unlock it but failed since this particular form has strong encryption method. ;)

The low income for 2013 is $71,991 (6 persons) as the extra 30% is already included in the calculation (according to the guide). To my understanding:
Low Income (for family sponsorship) = LICO + 30%

For example, 2014 LICO for 6 persons is $56,209 (http://www.cic.gc.ca/english/information/applications/guides/5196ETOC.asp#table3).
So, $56,209 + 30% of $56,209 = $73,071 (almost equal to your amount based on 2013)
I hope it's clear as mud. :D


Some call centre agents might say differently as noted before in this forum. But I would still stick to what the guide says.

If we make mistakes after validating IMM 1344 or the IMM 0008...can we fill again and validate again? I assume the barcodes are changing each time we validate them.

You can do as many times as you want. Just validate before final print and signature. And if I'm not mistaken, the barcode page (after validation) should go on top of the corresponding form (not a big deal though).

I am going to sponsor my mother only because my dad does not want to come. Also i have 3 brother all aged more than 19 (so they cannot be included in the application). SO in that case my mom will be the principal applicant.

So can you guys help in in determining that if my dad and my brothers need to fill out this form if i am not sponsoring them?

2. Same question for the additional family information form? Only my mom needs to fill it?

3. Does my mom need to include her marriage certificate even my dad wont be accompanying her?

Not sure if you can even sponsor your mother only without your father as part of the PR sponsorship. This would allow your mother to bypass the medical exemption clause if they allowed you to do this. Your mother would be allowed to sponsor your father with excessive medical exemptions.

I believe you have no choice but to sponsor both your mother and father same time. The only way you could only sponsor your mother without your father is if they are legally divorced.

For example. Your mother can sponsor your father if your mother was granted PR by herself. Your father would bypass the excessive medical demand clause if sponsored for PR by your mother. This loophole would be abused if they allowed only one parent to get PR without the other parent.

Plus if they allowed it, you would be only responsible for your mother for 20 years and your mother would be responsible for your father for 3 years. I can see people using this loophole not only abuse the excessive medical exemption but also bypass the financial 20 year obligation.

In conclusion, you cannot sponsor your mother for PR without your father. You must sponsor both your mother and father for PR if you want your mother to have PR.

Your spouse can be your co-signer so long as you meet the LICO requirement for total minimum income. Usually a co-signer is added when the sole sponsor does not meet the LICO minimum requirement, by him/herself. The co-signer can be added to help meet the LICO requirement of any given year.

My parents don't have marriage certificate but they got affidavit done.

I spoke to CIC agent today I was not sure if it is okay to submit affidavit instead of marriage certificate.

Don't know what to do.
