Hello,

This is my first post. I met my gf online last August.She lives in NY and I live here in Ontario. We are a same sex couple. We want to get married and live together here in Canada, hopefully before this December. I am on disability but I will be sponsoring her. A small wrench in our plans happened though when last October an unfortunate incident on both our parts here in Ontario left her with a 12 month peace bond. That peace bond has since been removed and we have worked everything out. We love each other dearly. What I would like to know is if We need to get her fingerprints destroyed before I apply for sponsorship or if I can apply for sponsorship before or at the same time as we apply for her fingerprint destruction which will be in October. we are also looking for any other immigration advice that may make the process smoother.

I can't comment on the peace bond. But can you confirm if she was charged? You'll need to ensure she's not inadmissible before you start the process.

Just to confirm - are you common law (have you lived together for at least one full year)? You must either be married or common law in order to sponsor her. I don't see conjugal (the third category) as a viable option for you since there are no barriers to marriage or living together.

Just read through your post more carefully. I don't think it's possible that you're common law at this time.

So before you apply, you'll either need to get married first or live together for a full year to achieve common law status.

She was not convicted. A peace bond is not a conviction. It should have no bearings on criminal records. She just needs to have her files destroyed.

We will be getting married this fall before we start the immigration process. Is it still possible to do outland when you are inland?

Yes - it's certainly possible to do outland while visiting Canada (that's what my husband did).

Keep in mind that she can only visit Canada while her application is in progress. She can't "live" here until she has PR.

She will qualify for OHIP three months after she becomes a PR. She certainly won't qualify for OHIP while here as a visitor. She should purchase travel insurance to cover herself for emergencies during this time.

With inland she will qualify for OHIP and a work permit once first stage processing for the application has been completed. First stage processing currently takes 11 months.

Each application is individual. But outland is typically faster for Americans than inland. The official processing time for outland applications for Americans is currently 12 months - but many get through much faster. Note that with outland, you don't qualify to work and get access to OHIP until the application is 100% approved and you have become a PR.

I don't understand what you mean by "fingerprints destroyed".

When a person is arrested, they are photographed and fingerprinted. If the charge is withdrawn and settled by way of a peace bond the fingerprints are still kept on file. When the conditions of the peace bond are satisfied you can get the mug shot and fingerprints destroyed. They will not be destroyed automatically so you have to apply.

A peace bond is like a restraining order but issued under criminal law. It does not leave you with a criminal record. For the OP, I think a chat with a lawyer might be worthwhile to see how this effects the application.
