Hi,

I am a PR holder living in Canada for more than 4 years now. I would like to sponsor my mom from srilanka. I was wondering if i can ask her to come to canada on a visitors visa and then to apply for internal sponsor. that is, can i file the sponsor here and ask her to continue the stay thereafter? I am single, have a permanant job, house to accomodate and my mom is living alone and she is over 60 years old.

Basically my question is "what would be my best choice so that i can sponsor her soon" ?
- can she submit for visitor's visa while her sponsor is being processed?

Hi,

She can apply for a visit visa even if her sponsorship application is in proces.

For the faster processing option, check the estimated times to process the cases from inside and outside canada at www.cic.gc.ca

Note there is no in-canada sponsorship for parents, she would have to be sponsored under H.& C. It is quite unlikely that she would be allowed to remain in Canada as a visitor for the 4-5 years that the application would take.

Hello everyone !

Can someone help me please.

I am a Canadian citizens and I want to sponsor my parents come to Canada. But my relationship with my spouse did not work out well so we were separated almost 2 years now. My spouse did not want to sign up the divorce paper. I already noticed CRA that I am separated from my spouse and CRA file my tax as single not family anymore

My question is : Can I sponsor my parents come to Canada under family class without my spouse because I known for sure he is not going to sign any paper work.

Do my spouse still counted as my family member? Or just me and my parents ?

You can sponsor your parents with your spouse. However I believe he is still part of the family size requirement. So in your case, family size of 4. If you want your family size to be 3, yourself and your parents, you must be officially divorced from your spouse.

We received sufficient applications to meet the Parent and Grandparent Program cap this year. The application period is now closed but will re-open on January 3, 2017, with a cap of 10,000 new and complete applications.

This is related to family law, not immigration...but...

If you are a resident of Canada and have been separated for at least one year, you can apply to divorce him without his permission or consent. If you've been apart for one year or more, you have already met grounds for divorce and if you want to divorce him, there won't be much he can do about it.

He can contest the divorce and claim that you haven't really been separated for one year, but that would be tough for him to prove. He could also ask a court to settle other issues (e.g. financial, etc.) but he wouldn't be able to stop the divorce itself.

These guidelines for divorce apply even if you weren't married in Canada.

We can't tell you that. You would need to meet with a family lawyer.
