Sponsoring adopted child outside Canada

Hi all,

I just would like to ask if how will it take to sponsor our adopted child to come here in Canada.

She's still back home because she was not included in my sponsorship application for during the time that we process the spousal sponsorship, we did not file the petition for adoption yet and was still waiting for the court's decision if it will be granted to us or not.

And now, the court had granted the adoption to us and she is now our legal daughter. Me and my husband are both permanent residents. I will start processing her application now however, I have some questions to ask:

1. We did not include any information about her when we applied our spousal sponsorship because she was not yet our legal daughter during that time. Would it affect her application when we sponsor her?

2. Would it be okay if I will apply for my brother to accompany her to travel to Canada once her application to come here is approved?

3. How long will the process take?

4. Where can I find more information about Sponsoring Adopted child outside Canada?

I would really appreciate any information that you will share with me.

Hi Scyla,

From Philippines. The adoption process completed and granted in the Philippines. We already have everything, the case study and the certificate from the court that she is now our legal daughter.

No.

Your brother will need a visa to come to Canada. He will need to apply at Canadian Embassy in his home country.

3. How long will the process take?
Posted wait time for Philippines is 19 months but that can be shorter also.

4. Where can I find more information about Sponsoring Adopted child outside Canada?

Additional Information:

Adopted children and orphaned relatives

A permanent resident visa cannot be issued to a child as a member of the family class if that child is the adopted child of the sponsor or an orphaned brother, sister, nephew or niece of the sponsor as described earlier in this guide unless the adoptive parents/the sponsor demonstrate they have obtained information concerning the medical condition of the child. In doing so, the government ensures that the child's best interests are protected.

If you are sponsoring a child whom you adopted or intend to adopt in Canada, or even an orphaned brother, sister, nephew or niece, you must complete and submit a Medical Condition Statement (PDF, 66.22 KB) with sponsorship application.

http://www.cic.gc.ca/english/information/applications/guides/pdf/medical-cond-en.pdf

You also need to contact Adoption Authority in your province to compete the process:

Adoptions are the responsibility of the provinces and territories in Canada. You should contact your provincial or territorial adoption authority for information on eligibility to adopt and the accompanying requirements that must be met, but first you should read all of the information in this section to know what to expect.

Once the adoption process is complete and you have received a Letter of No Objection from the province or territory, you can apply to sponsor your child. After that, you can apply for a permanent resident visa for your child to come to Canada.

You may apply for citizenship for the child after he or she has arrived in Canada and has permanent resident status. However, the adoption must be finalized before citizenship can be granted.
