Hi Experts,

This is my situation. I am a Canadian Citizen, and I have sponsored my wife in January 2011 with the application "Sponsorship Within Canada". However, we found out that she is pregnant in February 2011. Then I searched the cost of giving a birth within Canada is approx $10,000, and I couldn't bare the cost. So, I called the CIC office to speed up the application, and it rejected! Now, I am planning to ask my wife going back to the original place giving a birth, and the question is, can she allow to leave Canada while the Sponsorship Within Canada application is in processing?
 
yes she can it depends on her status in canada she is allowed to come n go if she is on a visitor's visa for example provided it doesnt expire...also an fyi inland sponsorship is longer than outland n a benefit is if outland is rejected u can appeal inland no appeal
 
assume my wife is going back to her original place tomorrow, what happen to the application "sponsorship within Canada"? Do i have to withdraw it from cic and re-apply the "sponsorship outside of Canada"? or it will be process ultimately?
 
I think u should withdraw as its a longer process n again if they do reject then u have to reapply outland u can apply outland even if she lives in canada

This is wrong, if the application is inland then the principle applicant (the wife in this situation) is NOT allowed to leave Canada until the process is complete....

Also it all depends on which VO they have to go through, sometimes it is quicker for an inland application, and if they are not from a visa exempt country there is a high risk of not getting a visa to come visit during the process in fear that they will not leave after the visa expires because they are coming to stay with a spouse...there is a lot more to look at for this process...
 
Hi StumpedMom, this is what my intention. My plan is let my wife going back to Hong Kong and giving a problem, and i wonder shall i withdraw the application, or just let the inland application process?
 
if she is here on a visitor visa for exampl n it expired and she did not get an extension she has to leave that is what I simply said

Well.. yes and no. One of the requirements for this category is that the applicant is residing in Canada, but theoretical short breaks would be allowed, and you don't get in trouble for leaving... IF you are able to come back. If, for whatever reason, the applicant is denied entry into Canada, they obviously can't attend their landing interview and the application falls through.

In OP's case, since the absence will be so long and might actually coincide with the interview, I would recommend withdrawing the application and re-applying outland. The process with Hong Kong won't be much shorter, but it would be on a significantly safer side.
 
I would be worried that if she got caught outside the country that she will not be able to return, then everything is scrapped. If you choose to withdraw your application, the good thing is, if Canada is visa exempt you can travel back and forth to see your wife and there is no issue with this, if you don't and CIC sees that she is out of country for an extended period of time, which could be documented at the airport, they may cancel your application and you will have to restart from the beginning as an outland application....the other thing is, with the outland application, you can always appeal any decision made vs the inland app where you have no right to appeal....

With an inland app the applicant is supposed to stay in Canada. But if she does not need a visa to enter Canada, if she leaves, there is a good chance she will be allowed back in, so everything will be OK. She can just come back claiming she is visiting.
There is always a chance that the border official will not let her back in, even if she does not need a visa. Especially if she comes back with the baby, I would worry about this.
You could withdraw the inland app, apply for outland, and have her stay in Canada with you until it is nearly time for her to give birth. Hong Kong timelines and inland timelines are similar anyway.

If medical expenses are the reason for withdrawal, I hardly think this will be possible :/ Pregnancies require check-ups and follow-ups and whatnot-ups, and none of it is cheap if the OP's wife has no insurance in Canada.
 
Just an advice ...some organizations help out in these situations (pregnencies where the mother doesnt have medical insurance and is waiting on an inland app) you should look for ones in your area.They help out in some of the costs but still not everything is coverd.Also look up the midwife organzation in your area to see what they can do to help u.

That is if you stick with inland.....good luck
