Hi, I'm deperate of thinking my situation now and don't really know where to start. I hope somebody has the same experience that can help and guide me thru.

I'm married with 2 kids (7 and 11 years old) back home in the philippines. And been separated for almost 3 years but not legally since that no devorce in the philippines. We already have a separate lives and signed an agreement that saying no bothering to each other. Then I found GF backup home and having a son, he is 2yrs old now. I am now a PR here in Alberta, Canada and I already file my devorce to my xwife and waiting for the final result.

Here are my questions

1.) If ever that my devorce will be out can I sponsor my GF as my common-law and get my 3kids?

2.) I talk to an immigration lawyer here in AB, Canada and they told me that I can sponsor them now because you have the supporting documents and you are already a PR.

3.) I have a alot of supporting documents as proof like Life Insurace, Credit Card, Receipts that I'm always sending money to her, Pictures of us together when I was back home, Birth certificate of your child as a father, do you think that can help me to get them?

4.) I already declared to my T1 Income Tax that I am in common Law relationship, do you think that can help?

I'm not sure I can help, but perhaps if we start by clearing up a few points:

1) is your GF living in Alberta with you or is she in the Philippines?

2) you state you have PR now, were you in the relationship with your GF at the time you received PR and did you declare her as your common-law partner on your application?

3) did you declare all 3 of your kids on your application and have their medicals done?

My GF and my 3 children are residing in the Philippines right now my GF delevered the baby in the Philippines 1 month after I arrived here in Canada. And when I arrived here in Canada I did'nt change anything my xwife and my two children are in my immigration record still, that was my big mistake. Now I really don't know if I have still a chance get them. I'd already filed a devorce to my xwife and I'm waiting for the result. My xwife is willing to give the children to me because she is also planning to ge outside the country with her BF. Do you think that my devorce can help me to get my GF and my children? :(

Just a couple of things you should think about:

a) did you know that it is a legal requirement that you live in Canada for 12 months before you can apply for a divorce (I'm not sure how long you've been living in Canada)

b) you don't have to have your divorce finalised before you can sponsor your GF, as long as you can prove the requirements under either common-law or conjugal class

c) if you declared your ex-wife and 2 children (with her) as non-accompanying family members on your own application for PR and they all had their medical examinations done then you would be able to sponsor those 2 children now, as long as you can provide the necessary legal documentation to show that your ex-wife is giving you full custody. It was not a mistake to tell the truth on your application

d) if living with your GF in the Philippines is not legal then I imagine you are going to have a very hard time proving that you satisfy the common-law requirements for sponsorship

e) if you can prove the legal barriers to living together/marrying your GF as well as proving your genuine relationship with her then yes, you may have a better chance of sponsoring her and your newborn child under the conjugal class

I'm living here in Canada as PR more than 2 years. We were dependent to each other my GF is not working right now she is totally dependent to me. We aready have a 2 year old son and the barrier is it is illegal to live with her when I was there in the Philippines because of NO DEVORCE LAW.

Is there a chance for me to sponsor them?

I'm a bit confused about Conjugal Partner because most of the forms that I filled-up only have a COMMON-LAW option for status?

your situation is kinda twisted..its hard because Divorce is still not allowed in our country..im attending a meeting with a local immigration consultant by next week in Dagupan City to ask for advice with regards to my own case.. I'll try to bring up your case to them, lets see what would they say..ok?
