Second sponsorship

Dear all, I am new to here. I immigrate to Canada with my first wife in 2002, and get divorced in 2011 in Toronto. I met my second wife in China and applied sponsorship class for her, she landed in Toronto in 2015 and because of the terrible difference we separated in 2016 after short living together. Then I want terminate the marriage but she asked a big deal (50% of my house for only 7 month marriage), she start a divorce case in family court, and my lawyer told me this type of case can last 6-8 years, currently the case still hang up in the court.

In 2017 I started a new relationship with my current girl friend. during these two years, we spend lot of time in China together, and recently we bought a apartment in China as our marriage housing. But now I feel really tired to fly often from Toronto to China, and also my girl friend is pregnant, baby is coming. I do not know is that possible I can apply a sponsorship application for my girl friend as common law partner.

Its been more than 3 years since your ex-wife landed so you can sponsor again. I would assume that this time they are going to check your app very carefully.

Have you spent 1 year continuously together? Sounds like that is not the case. Agree a 2 sponsorship and 3 marriages in quick succession after your 1st divorce. Especially since your second marriage sounds like a marriage of convenience.

I know it looks like a marriage of convenience. But it is not, there are two obviously reasons to proof it:
1. if it is a marriage of convenience, she got what she want already, both sides won't spend tons of money to sue in the court.
2. My second wife moved back to China after broke up with me, every time we have court conference, she attended the meeting remotely through phone from China.

Now I need some suggestion, should I submit the new sponsorship application for 3rd wife after new baby born or before that, any suggestion will be appreciated.

1.As said in the last comment, if you are not married and didnt live together for at least 1 year you cant sponsor her
2. The baby will not have any effect on your app, but if born after you already submitted your app you will have to update your app with IRCC
3. You will have to convince IRCC about your relationship, not us. However make sure you send them all this info (with actual proofs) to support you app and hope it will be approved

From 2017 I have visited my current gf for 4 times, everytime not exceed 1 year but add together have 1 year together already.

I think it will be a daunting task to convince IRCC considering the complicated history and relationship issues.
Truth is .....They will be suspicious and the process could take years.....Are you up to it?.....Can you handle it?
Not everyone gets an easy path!
My suggestion would be get a new lawyer, clean up the ' dirt ' first and then move forward. $$$$$$$
Have lots of quality time together with new family that will show good intentions.

I understand it is a daunting task. Thanks for all your comments. I think I will stay more time with her in China and make more quality time together and them submit the new application.

BTW, can I apply a Canadian passport for my new baby if he/she born in China. I immigrant to Canada in 2002 and became Canada citizen in 2006.

This does not qualify you as a common law couple. To be classified as common law, you must live together continuously at a shared address for at least a year. Visiting her doesn't count towards common law. You must actually live together with very minimal breaks where you are apart.

You'll either need to live together for a full year to become common law - or get married. Until then, you can't sponsor her.

Thanks very much. This is the exact answer I need. Now I know what I should do. Just arrange my living spend 1 full year with her in China and them apply sponsorship application.

If you got some support letters from your friends to show that your ex is not living in Canada since some years, it may make your point clear to IRCC.

As your ex is PR and not living in Canada since some years, she is not a PR anymore after two years outside Canada, in most cases. I am not sure weather it be considered by IRCC/ court or not. Can someone confirm this information?

Based on the fact that your future wife got the visa for France and Japan, she may be able to get the visa to Canada as a visitor and you may apply for her from inside Canada.

Be diligent and get help from a good qualified lawyer.
Clean up the mess first and then move forward otherwise you are in for a long hard expensive ride.
