Returned Application but unsure why!?!

I'm really at a lost at the moment and was hoping someone would be able to help me out.

I sent in my application to sponsor my husband through the inland spousal application and it was received in Vegreville Nov 5th. Yesterday our entire application was returned with the following letter dated for Jan 29/14:

"It appears you have submitted an application to sponsor an overseas family member. This office only processes application for in-Canada sponsorship. Your overseas sponsorship has been returned.." and then goes on to give up the call center number, website, etc


Why I am confused though, is that my husband has been in Canada since July 2013 on a tourist visa (we both came at the same time from living overseas) and I believe I submitted all the paperwork for inland sponsorship.
I included forms
IMM 5443 - CHECKLIST
IMM 1344 - APPLICATION TO SPONSOR
IMM 5481 - SPONSORSHIP EVALUATION
IMM 0008 - GENERIC APPLICATION
IMM 5406 - ADDITIONAL FAMILY INFORMATION
IMM 5669 - SCHEDULE A
IMM 5285 - SPOUSE QUESTIONNAIRE
As well as a receipt for 1040 (paid Nov 1st)

I have no idea why they believe I am applying for an overseas sponsorship! Is there anyone out there with some advice or have been in a similar situation. (I called the call center twice this morning and they just told me to check that I used the right forms.)

Hopefully, if it's determined that it's an error on their part, they'll give you priority treatment!

That's bizarre. On any of the documents have you listed your spouses address as outside of Canada?

Hire an immigration lawyer if you couldn't get any resource...

Really?!?! That would be a drastic move, unless CIC argues with the OP and doesn't either:

A). Explain why they think it's an Outland application

B). Admit it was their mistake and take measures to correct their mistake

If neither happen, then you might want to consult a lawyer.

Yeah I wouldn't be rushing out to throw your money at a lawyer until you've exhausted all the other options open to you.

Perhaps they have changed their policy on treating "visitors" as eligible for inland processing. Order the GCMS notes to find out...

Simply the in canada thing is for legal resident of CANADA and as long as he is on tourist visa, you have to use for outside canada. Hope that meets the eye.

Because he is just here on a visa u need to apply for the outland. When does his visa expire?

That is wrong. Many people have sponsored they spouses in Canada where the spouse had only a tourist visa or even no status at all.

Also wrong. The inland vs outland process has nothing to do with the status in Canada of the sponsored spouse.


If you read carefully, the OP's problem is that she sent an outland application package to the office that processes inland applications. Looking at the forms she sent, they all match an inland application and the office made a mistake in returning it.

@ OP: I suggest you call the call center and explain your situation.

CIC will most likely do neither of those things. Trying to wade through the levels of bureaucracy to get answers to anything here, will most likely drive the OP insane. The problem is that you can't contact Vegreville directly, or talk to the actual VO that reviewed the application, and the call centre agents at CIC can't access info from Vegreville. CIC will just keep insisting that OP didn't send in the correct forms, and I'm pretty sure it will end there.

By all means she should try to contact them, and hopefully she gets a sympathetic call centre agent who will actually do something. I would ask to speak to a supervisor also.

However at the end of the day OP may just need to send in a new app, and take the 3-months hit in processing time. Such is the reality when dealing with CIC. They make mistakes, and the applicant's end up suffering.

What did you answer for Question 4 in the Application Details on the IMM 0008 re office to processs application?

CIC still shows that the most recent form update was in Nov 2013 (IMM0008).
