Hi all, My own issue is I had a PGWork Permit. Before it expired I applied for an extension, which was refused. Luckily for me my company want to do an LMIA for me. However I am considering applying for a restoration as I have 70 days to go.
My questions are
1, Can I apply to remain as a visit and at thesame time apply for LMIA?

2, Can I apply to remain as a student at thesame time apply for LMIA since I have an admission?

3, Can I start working once the LMIA process starts or I have to wait till it's finished?

Which has the best chance.
I am in the express entry pool with 459 points.
Canadian experience was 10 months as at the time permit expired.

I will appreciate advice from anyone. Thanks.

1. You should apply to restore your status to visitor as soon as possible. Yes, your company can apply for an LMIA at the same time.
2. No. You need to have a study permit to be able to study and you cannot restore your status to a student visa. Your only option is to restore to visitor.
3. No. You will only be able to start working again once you have a valid work permit again.

Note that you cannot apply under EE while out of status in Canada. Also, any work experience you gained after your PGWP expired cannot be counted towards PR.

Thank you so much.
Please another question is. What am I chances of getting the visitor visa. Is there a high chance? Does it have a high success rate?.

Secondly, what is my status after applying to restore as a visitor? I am guessing it might not be implied status?. What is it? And can I apply for EE since I am applying under federal skilled?

Or what is your advice generally?

I don't think any of us can comment on your chances of getting the restoration application approved.

Once you apply to restore your status, your status in Canada will still be "out of status". Submitting the restoration application does not give you implied status. You won't have valid status in Canada again until the restoration application is approved. And you cannot submit an application under EE while in Canada without status. This is why it's important that you submit the restoration application as soon as possible. It can take many months for a restoration application to be processed.
